My husband has a $299 charge-off with a credit union checking account. His EQ report still shows a balance, and a CA is reporting it as well.
I have a savings account, at the same credit union, with a $25 balance. I don't use this account and want to close it. I want to write a letter to the credit union asking them to apply the $25 to his balance. Yay or nay? His EQ shows DoFD as 9/2011 with the credit union and 09/2008 with the CA. I'm pretty sure the 09/2011 date is incorrect.
As for the CA, he has numerous medical collections with them, and we don't have the funds for a PFD yet. No DV done, I'm sure the debt is his and the amount sounds close.
I don't see why they wouldn't other than you aren't on his account and they may not be able to.
Would making a payment reset the SOL? I don't want to open up a new can of worms....
It could. What state are you in?
Virginia
Virginia is one of 18 states that making a payment will not extend or restart the SOL. Only a written promise to pay will do that.
Whew! Thanks for the info, guiness. You're awesome.
I might think twice about closing the checking account.
If and when the charged-off debt is repaid, its earlier deletion will require a request for their GW.
Having severed postive business with them is not likely to promote incentive to grant GW.
It's her savings account, not his. And it is in good standing. He has a defaulted checking account.
