I have never lived in CA.  Tomorrow morning i will be filing a compliant with the BBB, attorney general's office, and i will contact my local district attorney's office.

OK just got a call from someone stating that they were with the lawfirm and i have a lawsuit against me for not paying a payday loan.  He said the contract was with cash advance.  I told him to send it to me in writing and i would validate that this is my debt and i would be more than happy to pay it if it is mine.  He told me that he would email it to me within 30 minutes.  It has been an hour and i have not gotten anything.  Guess this will continue until they either get tired or they send me something certified mail and give me the info that i want.

I feel your pain last month I has 4 and I just had enough so I am now paying them down and off. I took out the 4th paid off #3 # 2 was due to end so now I am down to 2 and by september I should have none but it is a stategy pay down and you can get out of this mess. good luck.

I was called several times by an Indian accented person claiming to be an investigator for a Los Angeles law firm.  I told him I would only speak to someone from the law firm with a verifianle California Bar Card, and also asked for the name and address of the law firm.

 

When I looked up the law firm I was surprised to see they looked large and legitimate - called their main number and they told me this is a scam and indicates my identity has been compromised.  The law firm has been unable to get FBI or Secret Service to do anything because the calls are originating in India.  They use services that make the caller ID look like a US based number, and keep changing them.

 

I had one more call, I think from the same person claiming to be with a different law firm.  When I told him the FBI would like to interview him and asked for the address where they could meet him he hung up.

 

There is no such thing as criminal charges for debt.  Most states that allow payday loans specifically prevent use of the check you sign to "secure" the loan in a prosecution for a bad check.

I'd probably clarify that just a little bit.

 

While there is no debtor's prison, there can be criminal penalties under certain circumstances if the debt was incurred through fraud or misrepresentation.  For example, one falsifies employment or income data on a credit application and the creditor relies on this data in deciding whether or not to approve the loan and / or how much a a credit limit to extend.  Also, it is relatively common these days for a debtor to wind up incarcerated for contempt of court when they do not appear for court-ordered debtor examinations. 

For the honest debtor, however, who suffers problems and for one reason or another cannot meet their obligations, there should be no worries about prosecution. 

 

I am glad to see that the point was brought out that payday loan checks are, in most states, not prosecutable should they inevitably bounce.  Few people are aware of that and it is a favorite tactic used by payday loan companies to coerce payment.

I have two payday loans in Florida with CashWebUSA; one for $300 and then the second for $250. I am currently out of work due to emergency medical surgery recovery for 12 weeks. I have called them every two weeks, explained that I can't make the payments but I would like to work something out to pay them when I return to work.  The CSRs tell me there is nothing they can do to assist me, that I agreed to have the monthly chargers removed from my checking out and they will ACH them.  My bank will not let me stop payment on them because I agreed to the arrangement with CashWebUSA. 

 

I am not disputing that I borrowed the money and not refusing to pay it back, just get an extension on paying it back when I return to work or to make a lump sum payment one month after I return to work and pay the debt but they refuse to work with me.

 

Is there anything I can do? How can I dispute the charges until I return to work? Also, I read that Florida has made payday loans illegal....what does that mean for me? that I only owe the principle amount? Please help!
