Please HELP! Need advice

Hello everyone!

 

Ok so I had a student loan that defaulted and was sold to ACS/JP Morgan Chase. I never paid them myself, but garnished my tax refund. Now that they are paid off I tried GW many times and always get a response denying my request. Then I started to think....hold on this is account is very old it was opened back in 2004 and I am pretty sure the last time I paid anything was to the original creditor only back in 2007 or 2008. I never made a payment to ACS/JP.

 

But after years of non-payment they garnished my wages and garnished my income tax refund twice until the full balance was paid. My question is does the payment they received from garnishment reset my DOFD? How can I find this out? I believe they reset it and I read somewhere that it was illegal. I am trying to get this aged off but now they are saying the last payment I made was in 2013 and so my new Date of First Delinquency was changed. But if I didn't make the payment personally, can they do that?

I don't know what to do at this point. I can't DV after its paid in full, so how can I request proof of the validity of the new DOFD?

No, it does not. Nothing resets the DoFD. NOTHING.

So they were lying to me on the phone! So how can I get them to validate that?

The only thing that would throw off anything would be the type of loans you had. Federal verse private. Nothing reset sthe DoFD other than Uncle Sam. They seem to have a special set of rules for him.

Federal student loans are regulated under a different set of rules than FCRA and may remain on your reports for a longer period of time.

Even if the loan is now with a collection agency, it is still federally regulated?  That's not good news Smiley Sad
