Portfolio Recovery

I have this collection account still on my credit after being paid in full. I was told they would remove it and I have wrote them yet again another GW letter. My question is the DOFD is 12/2009. Should this really still be reporting on my credit? What are your thoughts?

Yes

A DOFD of 12/2009 results in required credit report exclusion no later than 7 years plus 180 days later, which would be 6/2017.

 

Did they agree to delete as part of a PFD negotiation, which would make it a binding contract, or was deletion promised only after you paid?

Big difference from a contract point of view.........

Your DOFD is December 2009 and this December would be 6 yrs. I would guess it wouldn't hurt for you to call the CRA's and ask for an early deletion (if the Customer Service person doesn't understand what you are talking about, ask to speak with a supervisor). If they don't want to early exclude (EE) then I would file a complaint with the BBB and/or CFPB. If you have any documents agreeing to delete, remember to mention that in your complaint and attach the copy. You can also explain to the CRA's that you have a copy if they would like to see it.
