Disputes under the FCRA require identification of a specific inaccuracy, which then defines what must be investigated and ultimately verified, corrected or deleted.

A dispute that does not include specific identification of an inaccuracy can be dismissed without investigation, and has no information that requires any correction or verification.

 

Debt validation per se, without an asserted inaccuracy in credit reporting, only applies to debt collectors, not creditors.

Robert, so when you identify an inaccuracy and send in a dispute about said inaccuracy, how do you word it? Do you ask for it to be corrected, or ask for it to be deleted? Deletion would of course be the ideal solution.

What is important is that the communication be identified as a dispute under the FCRA, and clearly identify the specific information that is under dispute.

It is not necessary to lecture on the required outcome (either verification, correction, or deletion), as those are the alternte outcomes required by law.

 

Make sure you identify the specific reporting that is considered inaccurate, and include sufficient information supporting the assertion to permit the furnisher and/or CRA to investigate the asserted inaccuracy.  A dispute that lacks identification of a specific inaccuracy or adequate info so as to permit investigation of any asserted inaccuracy can be dismissed without any requirement to investigate.
