Reporting changed to all key derogatory...

Hi Forum Friends...

 

I was looking over my credit report after challenging a few things (and having most removed). One of the things that remained was an old account from Beneficial/HFC that was originally reporting lates and when it was closed and sent to a colletion agency. ( all of this was 2008 to 2009)

 

I contacted Experian, showing them that the account was the same as a collection that had been paid in 2011. (The collection shows on my account as well).

 

NOW both the collection and the OC report are replaced with all KD (key derogatory) without the delinquency dates or other useful information.

 

Because I am in NY, I should be able to get the OC removed because of the dates but with all of the information removed, is this possible?

The DoFD should be all you need to get both the OC account and the collection accounts removed.  NYS law is 5 years for COs and collection accounts if they are both showing paid.

 

Where did you get your report from?  EX doesn't have the DoFD, they use a "This account is scheduled to remain on file until____.

Okay, so using the alertplus credit report shows up different. Got it.

 

So that I could be more accurate I jumped into experian's dispute report so I could see what they had directly. I see what you are talking about with the 'remain on file' statements.

 

The account that I'm referencing has no 'remain on file' statement at all. It is reporting CO (charge off) from June 2008 to Dec 2009 and in the comments it says "Transferred to another lender or claim purchased."

 

The collector they sold it to has it listed as a C (collection) from Dec 2009 until (the month after)  I paid it Sep 2011.

You can contact the CRA directly and ask them what the FCRA Compliance Date is or when it is due to drop off your report.  The DoFD was to be reported by the OC within 90 days.  The OC account won't reflect paid since it was sold/transferred.

 

Does the collection account show paid?

Under status it is listed as "Paid, Closed." and on the payment history it is just listed as closed.
