On my TU report today I found an A/R inquiry from: NAFS dated 2/4/13
Thru research on the board and internet, I believe they are poking around due to two HSBC charge offs that remain unpaid (DOFD 6/2008 & 8/2008).
HSBC sold the COs to Portfolio Recovery. But Portfolio closed the files and ceased collections after I dv'd them a few years ago. Portfolio also deleted their CA tradelines from all reports. The HSBC tl's do remain, showing 0 balance and CO status.
So I'm wondering if Portfolio has now sold the accounts to NAFS.
Again, this is speculation because I haven't gotten any mail from NAFS......yet.
The limits on both cards were originally $300 and after fees/interest one card was COd at $604 and the other at $638. While I do have hte $ to PIF the higher amount I would rather settle with one of the companies for a lesser amount obviously!!
WHAT are my options here and what should I do?
Do I wait for the dunning letter (IF it's even coming?) and then DV?
Do I send them a letter NOW asking why they are poking around (not mentioning HSBC etc of course..I'll play dumb haha)?
If Portfolio sold the debt do they have to tell HSBC and if so should I call HSBC to see who owns it now?

ARGH. I worked so hard and just got my reports CA free.....now this.
personally id be on the phone with them right now asking what exactly is going on. either:
1) its nothing and you dont have to worry about it, or
2) you catch it BEFORE its a CA entry, and wont have to play the whole PFD/GW game.
but if it IS what youre thinking about yes, id DV same day.

I was worried that calling the may come across as "hey I see you looking at my stuff and I'm worried now".....ugh. I hate calling CAs.
Never call a CA.
If they did a HP on your CR send them a DV.
I saw you did a HP on my CR. If I you have a debt you believe I owe, please validate per FDCPA 809.

I would really prefer not to call them, definitely!
They did not do a HP. IT's under the "account review" section or whatever. Still send letter asking or wait and see?
How long ago was it? Them looking at your CR is considered initial contact and they should have sent you a dunning notice within 5 days.
They may never send you one it they believe you could not or will not pay the debt. They could have easily sent it to another CA.
I would send them a letter asking for DV.
They did the soft pull on 2/4.
I'll go back thru my mail from this week but I do not recall seeing anything out of the ordinary.

Is this okay? Suggestions welcome. Also what info do I give them so they can locate my information in their system? Just name and address? DOB?
Upon checking my TransUnion credit report, I have found that your company placed an inquiry on my file on February 4, 2013. This act qualifies as initial communication under FDCPA 809(a) and requires you to provide written notice to the consumer within five days. As of today's date, I have received no such communications. This constitutes as a violation of the FDCPA 813(A)(2)(A).
Please note, this is NOT a request for “verification” or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section.
