Q: I had an auto loan with HSBC. When the loan was close to being paid off it was sold to Santander (was never late) I paid the auto loan off. However, there is a 30 late in 2010 and a 60 day late in 2011. Sicne the auto is satisfied and closed. Should I GW in order to get the 30/60 day lates removed? As well this loan was opended in May 2005, last payment was sometime early this year, and when is this scheduled to fall off?
Any advice is needed...

I gather that the lates occured after sale of the account. Since the debt was in good-standing prior to its sale, then Santander is not considered a debt collector subject to the FDCPA. They are considered a "creditor" within the meaning of the FCRA and FDCPA, but not the original creditor.
You would GW them, as the reporting party, just as you would any other OC.
Exclusion of any monthly delinquency is 7 years from its date of occurence.
