SOL in Florida...

Okay, I understand that the SOL is 5 years in Florida... Here is the scenario...I recently had this debt deleted from the OC and another CA... Now I have been faced with this...

Can someone please confirm that the SOL has expired?  The SOL here in FL is 5 years, and the blood hounds are after me for this debt threatening garnishment of my wages and judgments for this debt.  For starters I was never current on the loan and it later resulted in a repo in early 2005.

Laz98, I was thinking the same thing.  I think they know that my dispute will soon be over with EQ (7/6/2011) and I am sure they cannot validate.  What I found strange is that in the letter they sent to me they stated they were prepared to file a judgment on behalf of their "client" Nicholas Financial.  Well Nicholas stated that due to the inaccuracies on the credit reporting for years they agreed to delete the entire trade line (I still have the letter).  Another collection agency with the same debt sent a letter stating that they have deleted all negative info.  Now these genius' come out of nowhere with the same debt trying to collect on the same exact debt...

When was the car repoed? 

 

Although the SOL is 5 years in Florida, with some auto loan contracts there are acceleration clauses.  It's possible that the SOL would not start until the acceleration clause was invoked.

It was repo'd early 2005.

Thanks for the update O6!  I actually called those jokers and I believe they knew the OC had deleted the account.  On 7/1/2011, the account was sold to another collection agency.  I will be sending them a DV the moment I get a piece of correspondence from them.
