SSN as Account Number

I’ve had my share of credit problems in the past, but after a lot of hard work, I’m well on my way to restoring my credit.  I’m now having some trouble dealing with an account showing only on my Transunion report, and I’m not sure what the best course of action is.  The account has my full SSN as the account number followed by several letters.  TU has blocked out the last 4 characters, which still leaves my full SSN showing.  

Several months ago, I sent a letter in accordance with Section 609 of the FCRA requesting they not display my full SSN…sent CMRRR with proper identification enclosed.  A couple weeks later they sent a credit report with my SSN blocked out correctly in the personal info section, but the account mentioned above still showed it.  I sent a letter (again CMRRR) pointing out the error and asking that it be corrected.  The letter was interpreted as a dispute, and I received back the “investigation results” with the account verified and still showing my full SSN.  I then mailed (CMRRR) a more strongly worded letter and made sure to emphasize that it wasn’t a dispute in bolded capital letters.  It was a failed effort because they once again interpreted it as a dispute, and I had the same outcome as before.

I attempted to call to get it resolved and was of course transferred to the special handling department.  I asked for them to truncate the number in a different way to not leave my full SSN showing, and they flat out refused to do so.  They claim the FCRA only applies to the personal info portion of the credit report, and they are not able to do anything to mask any part of the account number besides the last 4 characters.  When I asked if there was a supervisor I could speak with, the rep got very rude and then hung up on me.

It’s obvious at this point that I’m not going to have any success with this on my own.  This seems to be a clear violation of the FCRA.  Should I try filing a complaint with the CFPB or my state’s Attorney General?  Would it be better to contact a consumer attorney?  I don’t know if this is something they’d be able to help with, or if I can even sue under this section of the FCRA.  

If anyone has any thoughts on this or can offer some advice, I would greatly appreciate it.  I’m just really frustrated at this point and not sure what to do.  Thanks.

You need to contact and make your demands with whomever is REPORTING the info... The CRA only has to truncate in the personal info for them to be in compliance with the FCRA.

Any chance you have a link to that info?  I've spent more time that I care to admit searching for anything that definitively said if it applied to the entire credit report or only that portion.  The closest that I found was the FTC's Darcy Opinion letter.  I know it doesn't address the exact situation, but it sure makes it sound like I should have the right to request that TransUnion properly truncate the account number.

 


This responds to your letter dated concerning whether the Fair Credit Reporting Act ("FCRA") allows Trans Union or another consumer reporting agency ("CRA"), for security purposes, to "truncate, scramble or mask the account number and social security number" when making file disclosures to consumers. You report that such a procedure has been recommended to you by a consumer who was recently the victim of account takeover fraud by a perpetrator who fraudulently procured the individual's Trans Union file by impersonating the consumer. You state: "While some creditors truncate or scramble the data before they supply it to us, not all do; therefore, many of the account numbers on our file are complete and accurate, and that is what we disclose to the consumer."

 

Section 609(a)(1) of the FCRA states that CRAs, including major credit bureaus such as Trans Union, "shall, upon request (by a consumer), clearly and accurately disclose to the consumer . . . All information in the consumer's file at the time of the request" (emphasis added). If the "information in the consumer's file at the time of the request" includes account and social security numbers, the provision thus normally requires that the CRA "clearly and accurately" include such items in its disclosure to consumers. However, because the trigger for a file disclosure is a "request" by a consumer, a CRA may allow consumers (such as the individual in your letter) to choose truncation or other security measures in their own file disclosure. In other words, although Section 609 provides consumers with a right to all information in the file, a CRA may provide a method for the consumer to ask for less than all information and then comply with that "request" when it makes the disclosure.

 

In sum, it is our view that a CRA that always scrambles or truncates account (or social security) numbers does not technically comply with Section 609 because it does not provide "accurate" (and perhaps not "clear") disclosure of "all information" in the file. However, if a consumer's "request" for a file disclosure is framed so as to allow some items in the file to be abbreviated or revised in that fashion, a CRA making such a disclosure would comply with Section 609.
