Santander Auto Loan reporting TWICE. Help.

I need help on two negatives that are reporting on my CR. Auto Loan thru Santander Bank NA and Santander Consumer USA negatives reporting on my CR from 2009. Both the Same auto loan. 

 

 

 

First one from Santander Bank NA: 

Last payment Made was 3/31/2009

>Account 30 Days Past Due Date<

$500 per month, paid Monthly for 79 months 05/31/2009

Remarks: ACCT CLOSED DUE TO TRANSFER; CLOSED Estimated month and year that this item will be removed: 04/2016

>Maximum Delinquency of 30 days in 05/2009< 

 

 

Account CLOSED due to transfer? I believe it was transfered to Santander Consumer USA  because of a name change? I was 30 days late during the transfer too. 

 

But then Santander Consumer USA shows: 

Date Opened: 07/24/2007 

Payment Received: $14,106

Last Payment Made: 07/18/2012  < Traded the car in for my current one. 

Pay Status: Current; Paid or Paying as Agreed

Terms: $500 per month, paid Monthly for 79 months 

Date Closed: 07/18/2012

High Balance: High balance of $26,076 from 12/2011 to 07/2012

Remarks: CLOSED >Maximum Delinquency of 60 days in 04/2011< 

 

My CR shows I was 30 days late 10/2010 11/2010 12/2010  and 01/2011 OK then 2/2011 thru 3/2011 30 days late then 04/2011 60 days late then OK after that. Traded in the car in 2012. 

 

Whats the best way to ask Santander to see if they can delete the negative late payments off my CR. Would they delete just the negatives and then my account will report in the closed "positive" section on my CR? Do I only want to ask them to delete the negative payments and not the entire trade line. The account has been paid in full and it is an aged account. Removing a positive account can lower the score. right?

I would make a copy of both of these entries and send a letter of demand to Santander that they delete the first or you will file a complaint with the CFPB, IMO they cannot hit you twice with the same account just due to a name change...  Yes removing an OC account does change AAoA and may result in score adjustments but you dont want 2 negatives for the same thing. I would not ask for the GW at the moment, those lates are minor derogs and are not affecting your Fico at this time (30-60s affect for 2 years)  the account would have to be reporting 90 or better for Fico to be affected the entire time the late is on file.

gdale6  Awesome advice. Thank you for your time and input. I will compse a letter and send that out asap.  Should the letter be short simple and to the point?  How should I word it. I am no expert in writing these to the CO's.   I see that in May 2009 i was 30 days late then at the same time the Santander Bank NA account was closed and transfered to Santander Consumer USA in June 2009 is when that started reporting on my CR. 

 

 

I called and spoke to a rep at Santander Bank NA and she told me to contact Consumer USA, but to also how I should go about it, is to file a complaint w my credit bureas and report the error due to it being transfered. I told her tho they are the ones who report it to the bureaus so I am going to the source of the matter.

 I am writing to you about my credit report and a reporting error on it. My Credit Report is showing two of the same trade lines for the same auto loan reporting twice. I should not be hit twice just because Santander changed names. The first trade line is Santander Bank NA #**** before my account was transferred to Santander Consumer USA #**** in May of 2009 and closed. I want the first trade line from Santander Bank NA removed because of this error. 

 

Please delete the first trade line and update to all three major credit reporting agencies or I will be contacting CFPB and filing a complaint.

Update: I called Santander Consumer Credit reporting Dept this morning @ 866-923-9282 and she told me that both TL's are on the report because Santander Bank NA used to be Soverign Bank before they switched names to Santander Bank NA. Then in 2009 they switched to Santander Consumer USA and its one continious loan and why would they take it off my report of the reporing is correct & accurate?  I tried to tell her its two negatives reporting on my CR and not just one continuous one. <--- Is this true?

I am very confused. I kinda see what she is saying that its the same loan but I am torn on how to dispute it, should i send them a letter like GDALE6 suggested and tell them i will file a complaint with CFPB? 

 

I copied below how it reads on my TU CR.   In June 2009 it was transfered to Consumer USA.  Do I have a valid dispute here with it on my CR twice? or is she giving me the run around and telling me it truly is valid how it's reporting?

The answer you got from them is a bunch of garbage, when credit cards get sold to another bank you dont get 2 entries the new name appears and thats the end of it. I see how these idiots are getting away with 2 separate TLs, you should dispute the older of the 2 as never late you were not per the payment history, make sure to keep copy of this around you will need it for the CFPB complaint if they dont take care of it themselves.

GDale. I submitted a complaint to the CFPB. Santander came back with this on the report:

The tradeline for Santander Bank N.A is prior to SCUSA servicing the account in June 2009. SCUSA is only reporting the account from the date we began servicing the loan.

That's all they wrote. So can they legally get away with SANTANDER BANK NA reporting me late in May 2009 (but it's not showing on my CR, only ", and then when SANTANDER COMSUMER USA took over in June 2009 and I was late with them later in the year. It's the same auto loan!!! Should I call the CFPB and ask their input? HELP!!!!

The first account payment history shows the account was never late prior to handoff to their new name and it must show never late because that is what the payment history shows, this is the one you need to file the CFPB complaint on. The second part of the loan after the sale is the one you need to GW.

I would write the credit bureaus and if you have documentation, show them that is the same debt and to merge it, then go from there.
