Seen a new collection in the 6th-7th year?

I would like to know if collectors initially add a collection account to a credit report in the 6th or 7th year of the 7-year limitation. For example, the DOFD was in 2009 and a collector first reported in the 6th year in 2005. Another example is when one collector deletes because they no longer have authority to collect.  A new collector started reporting late in the 6th year or early in the 7th year.  I'm thinking most collections are reported early and rarely late in the process?

Sure they add collections to your CR if they can.

In most cases, a debt that old will have passed the SOL.

Some states have statutes/regs requiring, if SOL has expired, that the debt collector provide notice that they cannot bring civil action on the debt.

 

Other than that, a debt collector can report their collection at any time.  They are then required to report the DOFD to the CRA no later than 90 days after reporting of their collection.  The CRA is then required to exclude any reported collection, regardless of when reported, no later than 7 years plus 180 days from the reported DOFD.
