Sending a dunning letter to a debtor

Is it considered pursuing collection activity?

Yes. The bottom of the letter will say that this is an "attempt to collect a debt".

I remember you used that in one of your legal letters against a CA.

But if you DV the CA before they get a chanse to send a dunning letter which they have to per the law, then what choice do they have?

In such as situation, would they have to include their validation with the dunning notice?

They don't have to send you a dunning letter.

 

They have to send you a letter stating certain information.

Gotcha. Thanks.

I now hope the CA either

a) Sends the dunning letter now which would be collecting on the debt or

b) Sends the letter with {809(1,2,3,4,5) only}. Its past 10 days now but all the more reason why I want them to send it so I could claim they were late as opposed to them not sending anything and claiming that they did.

 

They have done a hard pull on 6th May and on the same day I called them from my cellphone and gave them my correct address but feigned absolute ignorance and hung up. I also sent out a DV CMRR the same afternoon.

So far no communication other than that they picked up my DV. The greencards been signed for but does not state the date picked up.
