As of the date of this communication, the account balance is $529.49. Because interest, payments, credits, fees, and/or other permissible charges can continue to cause the account balance to vary from day to day, you should contact is at xxx-xxx-xxxx to determine the exact balance. When I sent the DV letter I asked for specific info (proof that they are licensed to collect debts in NY, proof that the SOL didn't expire, their license #, etc). They did not provide any of that info. I looked @ my CR & 6/06 was when it was first reported as 30 days late. Should I work this out with them before they hit my CR? (Plains Commerce, the original creditor already dropped off of report). I'd hate to ignore this & it haunt me later.
Well, they aren't legally required to provide any of that information in those template DV's you see floating around the web.
So this account has not hit your credit report yet?

Ok. That's probably why they didn't provide it to me It was on my CR as Plains Commerce Bank but when I disputed it, it dropped off. Then I started getting these correspondences from Capital Mgmt & now Resurgent. The account has been closed since 12/06.
LVNV sucks, so they will probably report it for the next 2 years they legally can report it for.. just giving you the heads up.
I would offer to settle to be honest, unless you aren't worried about it showing for the next 2 years.
Most of the BBB complaints on them usually stem around the no dunning, and since you just got the dunning, they will play hard ball I am assuming.

(it was 6/06) I think they are trying to get it in before it runs out next month! If they do, will it stay ony report past the sol?
The CRTP (credit reporting time period) and the SOL (legal statute of limitations) are two different things.
The SOL refers to the time in which they can sue you for the debt to compel payment.
The CRTP is how long it can show on your credit report. -- They can still report this debt for 7 1/2 years past the DOFD, which appears to be June 2006. So roughly 18 months from now it will fall off, if it ends up showing.
