Ok, I received a settlement offer in the mail today concerning an unpaid account that went into collections. The collection agency has been trying to reach me EVERYDAY almost and I simply just ignored the calls.... They made me an offer of exactly HALF of the actual amount owed... which is Great ![]()
After receiving the settlement I acquired my Credit Report online to see if this Collection was being reported. It is NOT on Any of the 3 reports.... Since it is not being reported (YET) should I send them a counter offer with a PFD??? I was thinking that I can send them my version of the PFD sample letter from this site requesting PFD if I pay them the Settlement offer... Should I offer to pay the suggested settlement or since Im requesting a PFD should i offer them the FULL original balance???
Also, Im thinking that even though it is Not on my credit reports YET, I should still request a PFD because knowing them, as soon as I pay, is when the collection will appear on my Reoprt as a paid collection... so sending them the PFD now will cover me and prevent that from happening....
Any Advice???

Since it is not reporting a PFD would not work. Modify it to "If I pay you won't report" or something along those lines.
Same thing applies, get it in writing on their letter head.
How old is this debt? Still within suing SOL?

I believe that the debt is about 2yrs old (maybe a little less) it was a phone bill that I refused to pay (at my old house) because we had a huge wind storm and my phone line went down... they came out and said that it was working fine... but my phone still had no dial tone... i called them back out, they came and said the same thing... But my phone never worked.... So i stopped paying the bill but they kept charging me monthly, until the phone bill got up to $650.oo then they finalyy stopped billing me and put it in collections.... I refused to pay for something that was NOT working... I couldn't even use my phone & it wasnt my fault ![]()
But anyway... sorry for venting... But I dont know the SOL for my state... OHIO... If you know it or know where I can find it PLEASE post it here....

So should I NOT send them a letter requesting them to not report it if I pay???
Will sending them this type of letter (after 2 yrs) be grounds for them to sue me???

Yes, you can send the letter. He was just telling you what your SOL was.
As long as you intend to pay there is nothing wrong in sending the letter.

Looks like you are rebuilding. I would send the PFD. I just sent one for an exact scenario as yours, except it was a year older. In my PFD I said you will not report to any credit agencies and if you already have you must delete...
