Statute of Limitations

I have been sued by Midland for a old credit card debt. My court date is 1/12/15.  On the original tradeline, the last payment made was 1/14/2009. Statute of Limitation in my state is 6 years. If I can get the court date rescheduled, would I be clear on the SOL or does it go by when the case was filed? Any help with this would be appreciated.

SOL statutes are all based on the time/period for initiating legal action.

Your assertion of expiration of SOL would thus be based on whether they filed within the period, not when trial actually occurs.
