TRUE or FALSE

1.  If you get a collection deleted, it can come back on your reports, but the credit bureau must notify you in writing 5 days before they  put it back.  _________

 

 

2.  If you get a collection deleted, it is against the FCRA for the bureau to put it back. _________________

1. False. From the FCRA: If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other meansavailable to the agency.

 

2. It depends on why it was deleted. If the CRTP has expired then no it can never be reported again.

2.  If you get a collection deleted bc it was reporting incorrectly, and the OC or CA fails to fix or respond,  and then the CRA deletes it.,  can the OC/CA then fix it and put it back?

AFAIK (could be wrong) that if the information is correct and the CRTP hasn't expired then yes it can be reported.

 

But don't just take my word on it. Let others comment also.

Great question. I too have wondered about that.

 

I think like marine said if the CRTP is still valid, I guess it can come back; that has been/still is my assumption .

In a general sense, false.

 

It depends on the reason why it was deleted.

FCRA 611(a)(5)(B) governs the reinsertion of previously deleted information.  It is based on whether the information was deleted as a result of a determination in a dispute that it was inaccurate or could not be verified.  If the information was not deleted as a direct result of a dispute, the reinsertion requirements of sectin 611(a)(5)(B) do not apply. 

If the information was deleted as the result of a finding in a prior dispute, then the party requesting reinsertion must submit a "certification of accuracy of information" to the CRA, stating that, notwithstanding the eariled determination in the dispute, the information is nonetheless "complete and acccurate."

The CRA then rules as to the sufficiency of this certification.  Without such a certification, the CRA is prohibited from reinsertion of the information.

 

If the CRA does, in fact, accept the certification and reinserts the information, they must send you writtten notification of such resinsertion within 5 days of reinserting the information in your file.
