The dreaded call

Hi everyone! Its been awhile but here goes:
Just got a call saying that Im gonna be served papers. I called the number and its from CCI. They told me that the situation is from a payday loan back in 2005 or 2006. They really didnt know. I asked the who, what, when, and where questions and they just really didnt know that much. I did get a loan but it was more like 2003 or 2004 before I moved. I wasn't at this address back then and I'm nervous that they will actually come to my job. What should I do?

Please tell me you did NOT acknowledge the debt.  Research state's statue of limitations.  And please BREATHE.......  I had a debt collector threaten me with the debt going criminal if I defied a judge and failed to pay

FYI the SOL clock starts every time you do something (make a payment or agree to something).

 

If you didn't acknowledge the debt or anything like that make sure that loan you took out in 2004 (beyond most SOL most likely) and was settled back in 2004 you could be ok. If it was a loan from 2004 and you contacted them in 2006 or made a payment then its a different ball game.

I didn't acknowledge anything (I learned that here!) I've never contacted them or anything. This came out of nowhere! I thought they weren't allowed to make threats like that. I can't even figure out how they got my new phone number.

I'm not an expert,nor a lawyer,consult a lawyer of you get served.But I would DV' em them an wait till I get served.Then,no matter what DO NOT MISS THE COURT DATE.They will win automatically and get a judgment and you won't want that.

DV= Debt Validation letter.Check the sticky threads,you will get a better understanding of the credit and fico world.Read, read and read more.

The dv shoild be sent before? They said they were going to serve in 24 to 48 hours at home or at work. This is too much, I don't even work in the same city I did back then. I am way too stressed about this.

Type up a DV letter and send today.

 

Make sure you put in there that the first time they tried to contact you was (date and time) and that you are sending this letter on ( date you send the letter).

 

Send it return reciept with signature confirmation.

 

Put in there that you must hear back within 30 days and that they can not continue to attempt to collect this debt.

 

 

 

IF they have papers on their way to you - then it'll be a little too late for the DV letter but SEND IT ANYWAYS (ESP with Return reciept and sig. confirm) that will prove you sent the letter, and that they recieved it. But no matter what SHOW UP TO COURT if you get served. They will have to PROVE you owe and that its not outside of SOL.

 

If the debt ends up being 15 years old (or bogus) just ask for the case to be dismissed based off the statue of limitations on collecting debt.

Do some research on the companty as well as the number they called you from. I was getting calls just like this some time ago. I Googled the number and company and found others who were receiving the same type of calls. If the person you spoke with a terrible accent (maybe Nigerian.) I would say that they may be trying to scam you. It sounds funny that the person you spoke with had no information regarding this loan.
