Their idea is ridiculous.  The concept that you have to pay for almost going to court. SMH .

 

The doctor's office should have billed the L&I people in the first place and it should have never gone this far.

 

It would be great if you had this in writing so it could be addressed by your attorney, and I would say 5k is very light.

I told the CA that, the doctor should have billed L&I from the beginning. They claim my husband never told them it was for an L&I claim. I can't prove he did, and they can't prove he didn't, but regardless, this was a specialist that he could only see with a referal from his general practitioner who knew full and well that it was part of an L&I claim, and the nature of the injuries made it apparent that it was a job site injury... and I just have a hard time believing that he would say it wasn't part of a claim when the claim had already been opened.

 

But anyway, I  just mailed off the letter, my attorney focused on several points, but the one he said will be the most danming and will probably get this thing dropped, is that the doctor not only accepted payment from L&I which voided all collection rights for that debt, but they also accepted payment from my personal insurance which is a double payment. 

 

I feel a little sick, I keep picturing the worst case scenario because if asked why I didn't inform the doctor to bill L&I back when we got the first bill, all I have as my defense is that I was dealing with a lot at the time, things were terrible with my marriage and I told my husband that he needed to deal with it himself, so I honestly never saw a bill, I don't know what he did with the bills if they did come, and he doesn't know either.

 

On the other hand, I have proof that even when doctors do know that a bill was suppossed to be sent to L&I they still sometimes end up billing private insurance and later sent to a collections company, so this doctor could very well have just tried to back pedal because they had gotten themselves into a hole. 

 

idk, i'm really hoping it just gets dropped.

I think at the MINIMUM it will be dropped.

 

If the Doctor accepted double payment, they have some real explaining to do. 

 

I have changed doctors (specialists) several times because it seems like they trained the office staff with just how to add codes to get more billing.  I went to a hearing and balance doctor and they would bill a separate fee to look in each ear with a 'microscope' during a routine exam.

 

I had an on the job injury that went thru what is called here 'Worker's Compensation' and I always stressed to the Doc and the billing dept it was not on my personal insurance.  It worked out well for me, meaning the bills were separate, not necesarily the outcome.  I had to use their approved doctors and get referrals from them so it never got to my insurance at all.

 

If you stress to your attorney to 'just get it dropped' and for it to go away, he will probably honor that.  But at least he should be able to recover his fees.

So a small update

 

My lawyer just got a call from the attorney whose name was on our summons, the office we sent our letter to. She said she had no idea that any of this was even going on and that she is going to contact their client and she'll be getting back to us.

 

So at least some progress!

I just checked the courts website since we STILL hadn't heard anything on this, the account was still on DH's credit report as of last week, but we had sent a certified letter telling them to either dismiss or we were moving forward with the counter suit... and just now the status on the courts site says "DSM w/prejudice"

 

Dismissed with prejudice!

Hurray!

 

Now to get my friend a very nice gift for helping us through this.

I have to say, I am a little disappointed that the attorney wasnt 'slapped' monetarily (the only way to get some of them to pay attention) and also the Doctor that accepted double billing.

 

I have never tried to sue for anything but this time I was definitely rooting for the little guy, in this case, you.

 

Still, if it goes away for you, that is good.
