Ok, if the BBB & CFPB complaints get nowhere you would want to send them an ITS letter directly (intent to sue) listing the following violations of law:
FCRA violations;
15 U.S.C. § 1681i duties of furnishers to provide accurate information.
15 U.S.C. § 1681s-2 - failure to provide accurate information, failure to correct reporting.
if your firm does not remove the faulty reporting information, I will turn this matter over to an attorney for review and legal action in federal court. with additional counts as follows.
15 U.S.C. § 1681n Civil liability for willful noncompliance
15 U.S.C. § 1681o Civil liability for negligent noncompliance
I've had a similar situation going on for MONTHS with Midland AND TMobile.
(Although only about 20% of the original $900 they said I owed was mine...which has now turned into $1989 which I am NOT paying!)
Direct dispute- no go. T Mobile old me to get a court order to see their documents. BBB against both...no beans. CFPB - Midland finally folded after it has been in process for 3 weeks. TMobile is hanging in there but if this is not resolved I'll get them their court order.
At least since Midland was reporting it will likely stay off long enough for me to get a mortgage. Objective achieved. I bullied Midland and won! You can do it!
