What are my options with capitol one?

[ Edited ]

I have a payoff plan with them that was initiated after I got the letter that they would sue for $5000. The account is a CO that is still owned by CapOne. They have their inside collections agency doing the work right now.

If I am still paying CapOne is there any way I can get my credit report to saying "paid as agreed" since I am paying them to an agreed amount ? My equifax report says scheduled payment amount is $0 yet I am paying them like $100 a month direct debit. Also they reported that the account is CO after we setup our agreement.

The agreement started in sept 2011 but capitol the account reports as a chargeoff in Oct 2011.

No.

Paid as agreed means you are not delinquent...i.e., the account is in good standing.  That is not your situation.

You can, however, ask them to update the current status to reflect the actual amount you are paying per your agreement.

Stating that your agreement does not require payment is inaccurate.
