While waiting for court ordered arbitration, can a cc still ding you on report?

Hello,  Ive done wonders fixing my credit, but I have 1 $500 cc that a collection tried to get $3500 to pay off.  I fought, won summary, then the judge said I can push it into arbitration.  My cc contract says I can request the creditor pay for arbitration.  In the mean time the SOL has passed and they know it.  I sent a certified letter to both the CC and arbitration telling them that I am requesting they pay for it but havnt heard back (12 months ago).  Now, after I ran a dispute on my credit, all of the sudden they are putting derogatory marks on it.  Its odd tho as it is the original creditor, not the collection agency, and the amount listed is down to $2200 from $3500.  

 

While I wait for them to pay for arbitration, can they still ding my credit when it is up in the air?  Confused.  And of course its cap 1.
