Hello:
No-one replied on the Bankruptcy thread so I thought I would try here.
I just learned that my x wife filed for CH 13 and used my last name on the paperwork.
We have been divorced and she legally dropped my last name and took back her maiden last name.
Of all of the debts that she acquired and listed on CH13 paperwork, only the home loan was in our names. All of the other debts she acquired after her name was legally changed back to her maiden name.
When I search PACER, only her married last name (my last name) comes up, not her maiden last name.
Do I have any recourse in getting this changed?
Thank you
Is this negatively affecting you or your credit in any way?
No, I mean we agreed to SS the property between us, but everything else is hers.
Just curious about the name. I do not know the rules, but I think it was a cheap shot using my last name and not hers.
How long ago were you divorced. You have to show proof of identification. Maybe she didn't get her DL and SSN changed and used the married last name so they would match.
You might be right. Divorced about 3 years ago.
Have you asked her?
I never changed my name back to my maiden name after my divorce, didn't think I had to. Used it for about 5 years before the military made me change it based on what the divorce decree said.
As long as she isn't doing it to commit a crime it may be ok. I would ask an attorney just in case.
When I did a CH13 in 2005 I had to list both my married (I was divorced) and maiden names, there is a question on the paperwork that asks for all names former and current. Unless you are somehow being impacted by the BK filing or have reason to suspect it is fraudulent on her part there's probably not much you can do.
I'd say, if it isn't hurting you in any way, just let it go.
Sounds good to me. I was just curious.
