The FCRA includes provisions for civil liability on two grounds. Willful noncompliance (FCRA 616) and negligent noncompliance (FCRA 617)
Noncompliance on either grounds requires a showing of intent or negligence, not just error.
Negligent noncompliance is limited to actual damages. To receive punitive damages, willful noncompliance must be shown.
