Re: got a DV response. need some help please

It looks to me that if this CA was on your CR's, it won't be the next time they report. They are closing the collection and sending it back to the OC. If they didn't explain the reason then it's impossible to know why they are ceasing to collect for the OC but you can look forward to another CA popping up with this debt. At least this go around you might be able to pay them before they report or even better pay the OC for a deletion.

An FYI, they don't have to delete their TL.  And another one can be added.

Not saying the won't delete but they don't have to.

Re: got a DV response. need some help please

Thank you -- good to know.

i am still dealing with my insurance company on this account.

So I would rather not pay it until I know what the insurance company is going to do.

Re: got a DV response. need some help please

That response most likely will result in their deletion, but does not state as such, and they are not required to delete.

It states that their collection activity has ceased.

There is never a requirement to respond to a timely DV.  They can choose to simply cease collection on the debt until they choose to validate.

However, with their collection activity now terminated, the cease collection bar imposed by the DV now has no relevance to them.  Its just an information letter.

They have no requirement to delete the prior reporting of the collection based on lack of debt validation or termination of their collection authority.

They are required only to report their collection as closed, and the amount now under their collection as $0.

If they delete, it is voluntary.

No basis for dispute or compelling CR deletion.

Just wait and see what action they take.

Re: got a DV response. need some help please

Should I ask them to delete it? i really need it off i am trying to get a mortgage. It is the only thing stopping me.

So i am guess I am finding it hard to be patient.

Yes, you can always ask for their good-will deletion.

I would not assert any impropriety on their part, as I dont see any, and that is not likely to promote much good will on their part.
