Can Someone Help? Ex BIL indicted

on 33 counts of child pornography.  Most of them are listed as F2.  There was a six month investigation with these indictments handed down yesterday against 41, mostly men, but two women.

 

WHY isn't this slime-bucket in JAIL???  Won't there be warrants issued?  What is the procedure????

 

He has custody of my nephew, who is 14 and gets his daughter every other weekend, she's 13.  I'm just SICK over this and what this will do to the children.

 

I'd appreciate anyone's thoughts and opinions.

Sounds like the grand jury handed down indictments to the prosecutor. The DA, prosecutor, or equivalent will then go before the judge to have a warrant sworn out, at which time the police will pick him up. When arrested, your ex-BIL will go before the judge to proclaim his innocence or guilt. The prosecutor may request a bail amount, and other conditions, like giving up custody of the kids, staying away from other children, staying away from computers, etc. A trial date would then be set if he claims "not guilty" and likely, based on the severity of the charge, may end up remaining confined until the trial date or receive a bail amount so high that he can't afford it. And that is that.

I'm happy to hear that he WILL be arrested...I'm freaking out...I want him off the streets!

If he's been indicted, then an arrest warrant will likely be issued soon, if it has not already.

Criminal and civil matters are seperate. Even if the BIL is arrested and arraigned (where the court asks whether the defense pleads guilty or not guilty), he'll likely be offered bail and be back out.

 

Custody of minor children likely won't change, unless someone goes to civil court and requests a change in custody and presents evidence why custody should change--like a copy of the indictment. Even then, it might not be a slam dunk change in custody. All depends who has the better lawyer.

First of all, I'm really sorry you're having to deal with this, Fish. If it matters, you're a better person than many. Many people would choose to take the relative's side merely out of familial loyalty. You're taking the side of the victims. Too many people don't think about them. Smiley Sad


As everyone else has said, he needs to be arrested first. You can, if you don't fear reprisal, expedite the issue by contacting the detective/OIC on the case and ask them to expedite his arrest. Enough calls, and they'll move quicker. If you're leery of "harassing" LE about it, you can call and offer yourself as a witness or "source."

Once he's arrested, if he wants to make bail, a condition of his bail will *usually* be that he must stay away from ALL children, including family members. Also typical will be that he will have to stay away from areas that children promulgate (like schools, parks, playgrounds).

However, it depends on the state. What state is he in? Some states take child pornography more seriously than others. Smiley Mad

talk to the family and find out who is willing to take the kids. since he has custody i assume your sister cannot take them. you can contact child protective services who can remove the children if there is a present danger and place them temporarily with a family member until the family courts decides who gets the kids.

since there is an indictment and he will soon be arrested you should probably be able to get at least temporary custody of the kids.

Thanks guys.  There is a hearing on Dec 1.  One of the slime balls committed suicide last night.  This is just getting worse.

 

My sister is sticking by him and I'm kicking her to the curb.  If I had ANY inkling that a guy in my life was doing this...

 

I spoke to a detective yesterday and gave him information about an additional computer that was taken to the shop.  They just need to search for it.

 

This idiot, is trying to blame this on his 14 year old son.  My nephew isn't allowed to use his girlfriends computer unless she opens it with a password.  My nephew also has the mentality of a 10 year old.

The Grand Jury does not hand down these indictments unless there is some pretty dang good proof.  This has been a six MONTH invesitgation...there's evidence and loads of it.

 

I guess I'll have to wait until Dec. 1.  My brother wants the son, but my sister is a maroon.  Long story.  She's more interested in getting fake boobs than caring for her children.

Please Pray for a HIGH BOND.  He can't afford it and neither can his parents.  I know It's evil for me to pray for that because my nephew loves his father, but he's a danger to children.  There should be no chance taken.
