Employer Issue - Overtime pay

Anybody familiar with Overtime pay or Labor Laws? My current employer has never made us submit a timesheet, clock in or out or sign off on our hours worked now this normally hasn't been a problem but now I am working like 50-55 hrs a week as an non-exempt employee paid on an hour basis. I am worried about not getting paid for my overtime yet even though they keep telling me that they will start to pay for the OT but by law aren't employers required to have non-exempt employees track their hours worked in some way?

Timekeeping

 

The timekeeping law requires that time records be “true and accurate,. Though employers can decide what method they’ll use to track hours, they must track them in three ways:

  • Time in and out
  • Daily total hours worked
  • Weekly total hours worked

There are three methods for recording nonexempt employee hours:

 

  • Handwritten on time sheets by the employee
  • Punched on time cards
  • Logged through a computerized system

From what I understand, if your employer doesn't pay you the OT, and you have proof that you did work those hours (and never made an agreement that you would work any amount of hours for $x.xx) then you can file a claim with the DOL there would be a great chance you would win since your employer never kept track of the hours, and would be audited.

My wife just unfortunately went through a similar issue.

not sure about the specifics of your state laws but i know in mass its mandated.
