    <description>&lt;P&gt;The Application to Approve Employment of Attorney states, in part, the following:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;____________________________________________________________________________________________________&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;BLOCKQUOTE&gt;&lt;HR /&gt;The duly appointed trustee in the Chapter 7 case, T. . ., applies for an order approving the employment of (herself through her own law firm). . . to represent and assist the trustee (herself) in carrying out the trustee’s duties under the Bankruptcy Code. . .&lt;/BLOCKQUOTE&gt;&lt;BLOCKQUOTE&gt;After reviewing the facts and legal issues in this case, the trustee has concluded that the assistance of counsel (herself) is necessary to provide legal services to enable the trustee to discharge his/her statutory duties and will not duplicate the duties and services provided by the trustee.&lt;/BLOCKQUOTE&gt;&lt;HR /&gt;&lt;P&gt;&lt;BR /&gt;The problem I see is that, while the Motion is probably "boiler plate" - meaning used in all cases with only the&amp;nbsp;debtor's name and case number changed - the motion makes no mention of an attempt to sell an asset of the estate.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Assuming the language in the Motion is boiler plate and the Trustee is simply hiring herself as an attorney to effectuate a sale of real property, I see this as an exercise in futility.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I do realize OP’s attny has indicated that he/she expects the Trustee to sell the property in 2-3 months and such may be&amp;nbsp;routinely done in&amp;nbsp;OP's district&amp;nbsp;but. . .&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;A review of the asset shows that there is almost $150k owed on it (including property taxes which, I would image, are ahead of the mortgage lien) while the property is worth an estimated $93k. Short sales by bk trustees are possible, and Florida trustees are known for their aggressiveness, however, unless this Trustee has the lender agreeing to release its lien for a substantial discount, it aint going to happen.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I just love it when Trustees, due to their greed, try to create $$ where there is none. So sad.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;In this case I hope it works because, if it doesn't OP will have to resume paying the HOA and will have to continue to pay the HOA until the property is foreclosed - which, according to my understanding, in Florida, could take 3 years.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Des.&lt;/P&gt;</description>

      <description>I just checked Pacer and see that the trustee filed a "Motion to employ or retain counsel" on 05-14-25. The judge signed off on it same day. I can't get the document to load on pacer at all. I have no clue on what it could be for. I had my 341 meeting on May 6th. What could this be and why would the trustee hire a extra lawyer to help her with my case??? Please help</description>

      <description>Thanks. She mentioned something about selling the "phantom equity" in my home since I'm letting it go in the bk. I don't live in the home and haven't since last April. I told her I have friends/family living in it for free cause they needed some place to stay. She kept asking if they paid me any money to live there and I told her no, I was thinking she hired the other counsel to dog into that to see if they have paid me or something</description>

      <description>The lawyer told me she would have it sold in 2-3 months. Which is a good thing since the USDA was going to take 4+ years to forclose on the home. Note if she sells it ill be able to buy sooner than if I waited on them to forclose.</description>

      <description>&lt;P&gt;If this is a BK-7 you cannot be hit with a FC since the debt will be discharged in the BK so as far as getting a new home loan Im pretty sure the timeline would be from the month you filed your BK. FHA is 2 yrs after BK.&lt;/P&gt;</description>

And just to be clear they can &amp;amp; will foreclose, it just won't be on your credit report because your responsibility for the debt was discharged. Also because of BK7 discharge if there's any deficiency (sells for less than you owe) they can't come after you for any of it.&lt;/P&gt;</description>
