    <description>I have a question and just looking to see who could or would answer it for me. &amp;nbsp;In 2001 I had a chapter 13 that ended up being dismissed by the trustee because I did not add in an electric bill. &amp;nbsp;Anyway we had to pay off all those debts and then I was informed that when you have a chapter 13-dismissed it can stay on your credit report for 10 years not 7 years as a chapter 13-discharged. &amp;nbsp;I don't know but I did not get anything out of filing this BK and had to pay the lawyer and money to the trustee which of course was returned to us by the trustee. &amp;nbsp;The problem is I don't understand why it has to stay on my credit report for 10 years just like a chapter 7. &amp;nbsp;At least with a chapter 7 your debts were dismissed in my case they were all corrected by us and paid by us so why 10 years. &amp;nbsp;TU and Experiean removed it after 7 years but Equifax is hanging in there. &amp;nbsp;When I looked at my credit report from My Fico on Equifax it has a case #, the date and the status but every other thing says Not Reported. &amp;nbsp;I am thinking of writing to the court if I knew the address - I know it was the Federal Court but that is all I remember. &amp;nbsp;I am wondering if I sent a letter to Equifax asking why there is no other information but the case number, date and status that maybe this could be removed early. &amp;nbsp;I am just wondering. &amp;nbsp;Any help would be apprecviated. &amp;nbsp;Thanks.</description>

      <description>&lt;P&gt;Bankruptcy discharge in Sept of 2005. I had a Porsche that was voluntarily repossessed but was included in my bankruptcy. I have a letter from Porsche stating that this was included in bankruptcy. After 5 disputes or more Equifax keeps stating that it is being reported correctly. I have sent them a copy of the letter and Porsche also gave me an audit control number that shows that it was reported to credit agencies. Equifax was given all this info. The girl from Porsche says they don't have to remove if they don't want to.&lt;/P&gt;&lt;P&gt;Shouldn't this be stated that it was included in bankruptcy; not reporting correctly bal due and late payments and voluntary repossession. It's killing my credit.&lt;BR /&gt;After I disupted it the last time my fico score dropped 63 points!!!&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;</description>

      <description>&lt;P&gt;It is true porsche does not have to delete it if they dont want to, but it should be reported as "Included in BK". I would let a lawyer in on it if its killing your score like that, seems the CRA is playing hardball. Play hardball back.&lt;/P&gt;</description>

      <description>&lt;P&gt;We worked with the credit reporting agencies and had great luck getting inaccurate items corrected.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;But we had an account that continued to report inaccurate information.&amp;nbsp;&amp;nbsp;I understand that&amp;nbsp;a CRA&amp;nbsp;may verify information without contacting the creditors directly.&amp;nbsp; One dispute resulted in a response claiming the CRA&amp;nbsp;verified information twice.&amp;nbsp; We checked with our creditor and they showed no contact from the CRA's.&amp;nbsp; They did get it cleared up eventually, but if you're running out of energy, an ethical attorney might be helpful.&amp;nbsp; Sometimes it just takes a little time and effort to make sure everything's correct.&lt;/P&gt;&lt;DIV class="message-edit-history"&gt;&lt;SPAN class="edit-author"&gt;Message Edited by utah2009 on &lt;/SPAN&gt;&lt;SPAN class="local-date"&gt;04-09-2009&lt;/SPAN&gt;&lt;SPAN class="local-time"&gt; 07:15 AM&lt;/SPAN&gt;&lt;/DIV&gt;</description>

      <description>Before you go recommending agencies to handle this, don't waste your money. They can't do anything more than you can and its a myth that they magically accomplish something you can't yourself. If you do it properly, you will. Have you asked yourself if they are so good and special, why you never see a copy of the letters they send to the CRAs, somehow that's their secret sauce they claim. Because there is nothing special about it, and often the CRAs will play more hardball when they know you are part of some mass repair company clientele because they know what you THINK you are accomplishing, "the big guns".</description>

      <description>This has nothing to do with being afraid and they can be reputable, that's good. But the fact is that they are bound by the same laws you are and there is NOTHING they can do that you can't do yourself. It is a self fulfilling prophecy unfortunately because when they get something removed its often for the same reasons you get them removed yourself, the CRA fails to do it in a timely manner and is required to remove it. Nothing to do with specialized skills. You would hire and attorney to help you when you are in jail or getting sued but this is not even close to the same thing. These companies are a room full of computers, canned letters and a bunch of people hired to work $7-10/hour to punch in your information, print, put in envelope and mail. There is no specialized anything. They only legitimately use the statute that allows them to do this for you for a fee to run a business and make money. You could pay someone to go do your grocery shopping for you too but that doesn't mean they have some special skill that allows them to do it and you can't do it yourself. If someone doesn't have time, then I can see them being useful but otherwise, totally unnecessary.       <description>I called Equifax again and now suddenly the item is corrected to reflect bankruptcy. My score jumped 30 points suddenly and FINALLY! I have to say I disputed this item at least 5 times; couple by mail; couple by internet; one by phone. I tried each method and this last time I used the fico.com letter that was generated and sent it in with my porsche letter and is now fixed. hmmmm?</description>

      <description>Not 100% sure but I believe that's because the case was filed and considered, even if it was dismissed. Think of it like when you file an accident with your insurance company, even if you don't take their money and go fix it yourself, the fact that you told them will probably bump your rate and go on record. It sucks though, I'll give you that.</description>

      <description>I realize what you are saying and you are right in comparing it with a car accident but the difference is the car accident only stays on your insurance report for 3 years and 4 months. &amp;nbsp;The thing that bothers me is not that it is on my report as I was the one who filed so I had to expect that but to keep it on my report for 10 years instead of 7 when I received no benefit from it is not quite fair. &amp;nbsp;I know it could be worse it could be all 3 CRA's that are reporting it but it is only Equifax. &amp;nbsp;Just thought that if there is no information on myfico excpet for the case #, date and the status I thought maybe I could dispute this as I don't think it should all say not reported. &amp;nbsp;Just wondering. &amp;nbsp;</description>

I used that as a way to clarify what I meant by once it makes a mark, it stays mentality of it. Trust me BK sucks dismissed or not in your case. I am a bit surprised that EQ of all is being the difficult one, I mean I know they have some idiosyncrasies that others don't but generally they are not the one that is a pain, its EX or even TU before EQ, or so has been my experience so far. It won't hurt you to dispute it and ask them to remove it stating that its old and should no longer be considered relevant and see how it goes. It might have simply been overlooked and you asking them to remove it might just accomplish it without too much effort.&lt;/P&gt;</description>

      <description>I did not take any offense to your comparison and it was a very good comparison for me to understand - so it really was fine. &amp;nbsp;I think I am going to contact Equifax and see maybe they will remove it instead of trying to get the court to remove it. &amp;nbsp;I thank you for your time and for your knowledge. &amp;nbsp;Take care and again thanks a lot.</description>

In this case, I would say probably better luck with the CRA instead of the OC (court). Let us, or at least me know how this goes and I will keep my fingers crossed for you.
