    <description>&lt;P&gt;i need help please. &amp;nbsp;i got this on my score yesterday. &amp;nbsp;i do not know who they are and i am in ny. &amp;nbsp;When i key the company 'midwest recovery systems' in the complaint section, it cannot be found. &amp;nbsp;&lt;/P&gt;&lt;P&gt;Also, beside bbb, where else should i report so it goes away from my credit report.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Any assistance will be greaty appreciated&lt;/P&gt;</description>

      <description>&lt;P&gt;Out of the blue I got an alert today on MyFICO a collection was placed on my Experian report from Midwest Recovery Systems. I do not know who these people are. I never recieved &lt;STRONG&gt;anything&lt;/STRONG&gt; from them by mail about his pay day loan debt. Which I have never done before. It says I owe $655.00 on MyFICO. I will contact my lawyer on Monday. I have filed a complaint so far with the BBB and CFPB, and disputed it on Experian. I have no collections on my credit report until now.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Kicker is I was BK Chap7 DC'ed last year 11/15. And these people pull this stunt? I get a few of those scam calls about old payday loans I owe that I have never done before. I tell them all I am post discharge and I never had a payday loan. Have a nice day. Any other ideas folks?&lt;/P&gt;</description>

One day after filing with the CFPB:&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Company responded&lt;BR /&gt;Midwest Recovery Systems said:&lt;BR /&gt;Explanation of closure&lt;/P&gt;&lt;P&gt;&lt;EM&gt;Our bankruptcy policy is once we have been notified of a bankruptcy we get as much information including case number, attorney, chapter, and any other information possible. We immediately stop all collection efforts and send a record for deletion to all three credit reporting agencies. At that time we close and return the account as a bankruptcy to our client.&lt;/EM&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Yeah right. They never contacted me about anything, by phone, mail, nothing!. Just add a collection to my report on Experian.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Thanks for no responces. Hope this helps someone who has to deal with the same issue..&lt;/P&gt;</description>

      <description>&lt;P&gt;Hopefully your attorney can get it removed. They needed to have sent you a letter giving you 30 days to dispute the charge prior to it being placed on your credit report so you have time to dispute it. If they didn't and can't show proof that you did get the letter you could most likely get it removed. Most likely they placed it in hopes that you would just pay it. Maybe you can just sue them and get some money in your pocket &lt;img id="smileyhappy" class="emoticon emoticon-smileyhappy" src="https://ficoforums.myfico.com/i/smilies/16x16_smiley-happy.gif" alt="Smiley Happy" title="Smiley Happy" /&gt;&lt;/P&gt;&lt;P&gt;I'm meeting an attorney tomorrow to discuss incorrect credit reporting myself!&lt;/P&gt;</description>

I helped them get one of their employees fired. And they brought charges against him. Working for collection on the side and looking up poeples court records. Unreal.......&lt;/P&gt;</description>

I just wouldn't ever think a courthouse employee would do stuff like that. I have a voicemail from the company I want to sue where the girl flat out says that I have to pay/reaffirm my debt with them, or I need to give my item back before they update my credit report. I'm like 1st off both of those are basically threats, and you can't demand I pay the bill or give anything back before you update my credit.&lt;/P&gt;</description>

      <description>&lt;P&gt;After 3 days of waiting. I went back on the CFPB case page and disputed that this company has not deleted the collections from all 3 CRA's as promised. After finding out the so called companys name they listed as the creditor on CRA's. I researched and found out on the BBB page. There was an alert, and this company wasn't in business since 2013. So they're trying to collect on a debt from a closed company? Really? How low can you go! And Midwest's collection license in FL expired in 2013. &lt;img id="smileymad" class="emoticon emoticon-smileymad" src="https://ficoforums.myfico.com/i/smilies/16x16_smiley-mad.gif" alt="Smiley Mad" title="Smiley Mad" /&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Three hours later. Ching. My FICO alerts. All collections gone. Scores back up from 33 to 36 points. Glad its over. I think it's interesting that everyone impacted by this seems to be a CK user, and it's only been about two weeks since I signed up for the CK service ...&lt;BR /&gt;&lt;BR /&gt;Anyway, I filed a complaint with the CFPB. I'll also file a police report tonight and keep everyone posted on progress. What a scam.&lt;/P&gt;</description>

      <description>&lt;P&gt;This exact thing happened to me on Monday.&amp;nbsp; Popped up on all 3 bureaus, tanking my scores BTW.&amp;nbsp; I have now disputed it with all 3, filed a complaint with the CFPB, BBB and FTC.&amp;nbsp; They aren't even licensed to collect debt in my state (I checked).&amp;nbsp; No letter in the mail, nothing.&amp;nbsp; Got an alert from Experian this morning that it was deleted (though it hasn't hit MyFico yet so I'm hoping my scores bounce back when all is said and done.&amp;nbsp; Ridiculous!!!&lt;/P&gt;</description>

HOWEVER - lack of reciept of a dunning notice on the part of the debtor is not pima facie evidence&amp;nbsp;of a violation of law. What it does do is make your DV timely, as that 30 day clock is based on your reciept of the dunning notice, and not their sending of it (often to an old address). Any collection activity by them after your DV is a clear violation of FDCPA.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Attempts to (knowingly) collect on a BK discharged debt is a violation of US bankruptcy law.&lt;/P&gt;</description>

      <description>They did the same thing to me last week. They wanted me to pay 640 dollars for a payday loan from 2012 and they would delete the account after I made the payment. I have already verified with my bank they said the loan went into and no loan was placed in the account at all. They said probably a paper check was sent to me instead of a direct deposit. I live in NC and I thought payday loans are illegal in my state. I have already disputed with experian. I requested full debt validation and they said they would send it to within 30 days. Then after that if I disagree they would me file a fraud report to get it removed. Would I have any grounds to file a lawsuit against them?</description>

      <description>&lt;P&gt;As I started this post. I showed all that i did. It all worked in 4 days and the CRA's were notified by MRS. Everything deleted in 2 hrs after uploading proof no such company existed. I always heard back from the CFPB until I sent the proof of a closed business. They were not licensed in my state, and the company that they had as who they were hired by was a closed business. I have not heard back yet. So the CFPB does forward things to the FTC. This may be the case. And the threaten to sue from my lawyer to them a day earlier put enough heat on them to delete. Follow what I did and you'll be fine. Unless you did use a pay day loan in which I never have.&lt;/P&gt;</description>

      <description>Just got notice from cct that this account was added for $870 and never received anything. I will be doing the same thing everyone else did today. Of course my scores dropped which sucks because I was hoping for cli for Christmas. Ugh</description>

      <description>&lt;P&gt;As an update to everyone after disputing with all 3 bureaus, the CFPB and the BBB, I've had it deleted from all 3 bureaus though for some reason, my Experian score hasn't gone back up yet and the other 2 have so hopefully that will happen soon.&amp;nbsp; On another note, I FINALLY got approved for a Walmart cc.&amp;nbsp; Granted, it's only $500 but was hoping to have it for Christmas as cash is tighter this year than last due to a new car bought this year but I finally got it!! &lt;img id="smileyhappy" class="emoticon emoticon-smileyhappy" src="https://ficoforums.myfico.com/i/smilies/16x16_smiley-happy.gif" alt="Smiley Happy" title="Smiley Happy" /&gt;&lt;/P&gt;</description>
