US Trustee Review - Quick Question

Hi All,

First and foremost, thank you to everyone who regularly posts on this board. The wealth of knowledge on this entire forum is irreplacable.

I filed for a No-asset Chapter 7 on Nov 1. My MOC is scheduled for next monday, 12/16. My case was audited by the US Trustee (Over median income) and I had to submit a couple more documents for them through my lawyer. My lawyer just sent me an email stating that the UST has advised them that they have completed their review and have no further requests of inquiries. I know all cases are different, but with the UST saying they are all set, should my MOC be a breeze?

@hitaway4, From my experience, you're good to go.

At my 341, things went well.....a few questions from the trustee, no creditors were present (could've been 35 or more), etc....

There were in a few people in the audience, maybe 3. The trustee asked if they had any questions or if they were there to hear my 341, etc...1 lady spoke up and said "i'm so and so, from the US Trustees office'...That caught my attn....She continued to ask me if i had a business, if my daughter was an authorized user and if she ran up the debt, asked about my 401k withrdrawals 18 mos prior.....

So my 5 minute meeting took about 30.

I'm dismissed and my attny and the us trustee pow wow in an adjoining room for a good 10 mins while i stood out in the hall. Attny comes out, US trustee wished me good luck.

Then attny tells me she want 401k docs and credit report. Attny says once we get her off our arse, we're all clear.

Point is, seems like the US Trustee is off your butt already so relax and be patient with the process. I'm 69 days post DC with an open case still, so i'm the poster child of patience.

Quick Update:

I had my MOC on Monday 12/16. Showed up a bit early to view some of the earlier MOC's to see how it is. I know this has been reitterated countless times on this forum, but do not stress about the MOC. From the time I was called up, until the trustee saying "Good luck" was 4 minutes. All yes or no questions. I checked PACER today and the report of no distribution has been filed and the trustee has asked to be taken off the case.

I have read that the US Trustee has 10 days after the MOC to file an objection. Since the UST has already reviewed my case (And said they were all set), should I be in the clear and consider myself in the 60 day club? Or should I not count my chickens until the 10 days has elapsed? I'm caustiously optimistic, but haven't let myself breath a sigh of relief yet.

You already submitted the extra documents the Trustee wanted and they were satisfied. Consider it done. They signed off. Congrats!

Go ahead and breathe a sign of relief. The trustee filing a notice of no assets is them washing their hands.
