Question about car loan and bankruptcy

I am about to file bankruptcy and just retained an attorney. Wells Fargo, while I am not horribly late, a few days actually, is calling and saying they are going to repossess my car.

Can they do that if I'm in the bankruptcy process? I just retained the attorney yesterday and he plans to file with the court within the week.

They must stop collection activity once you've filed. Until then, they can try anything they want. Don't let on that you're filing BK. They might try something sneaky. String them along as best you can until you've officially filed.

Until you have actually filed and the court clerk time-stamps your petition, the creditor is free to take any legal remedy available.
