Wells Fargo CPI Refund

In 2006 my ex-wife and I took a loan from wachovia dealer services which was eventually bought out by Wells Fargo dealer services.

We filed bankruptcy in August of 2010 with a discharge of November 2010. The creditors were Wachovia Dealer Services (Wells Fargo Dealer Services), Capital One (hers), Kohl's, Les Schwab, and a small local dealer. She may have had a Walmart card at the time too.

On March 22nd Wells Fargo sent a letter to the trustee stating that they had incorrectly charged us for CPI and we're issuing a refund check in the amount of $4,950.83.

Our trustee is retired and the bankruptcy courts have not responded in the requested 45 days.

Has anyone ever dealt with this?

If so what was your experience?

And yes I have called our attorney from the time put being 9 years old they don't know much at the moment either. They are going to try to call me back in the next day or two.

To update this because it exceeded the 45 days to check will be cut to my ex-wife and myself. It will have an and in it meaning both of us have to be present to cash the check.

It will be mailed to her because she was the primary borrower.

I was told the check will be cut sometime in 2019. That is the best answer that they will give me.

Congrats. I read they have a class action lawsuit for that as well. We are looking to see if we were part of the suit as well since our mortgage was from one of store front Wells Fargo as well.

FYI: I received notice of this proposed settlement today myself. I had a crappy loan in 2006 and reposession in 2011 that screwed my credit for years. I'm curious to see what ultimately comes of this myself. It looks like it should be something in exess of the base $4000 settlement for customers who had a repo. I saw on AVVO and reddit two people who received (or will receive) $8600. This will be my SECOND class action suit with WF I've been included in!

FWIW: To this date I still have never taken a car loan but opted to pay for them all up front and I really like my little credit union now.

Hi I was going through the same thing as far as getting the CPI insurance added to my car and all of a sudden getting my car repo did hiu already recieve a check? All I got was a notice of class action lawsuite I honestly thought it was a scam or that it would be just a few dollars but I was reading on line some people got 5k back refund already I'd there anything I need to fill out to get it or? I know the paper says that I'm definitely in the class action for sure because of my loan with feds please if you have any info let me know could really use that money now

I also recieved a notice indicating that was a settlement member and didnt need to provide anything. However, Wells Fargo sent me a notice via FED Ex that they needed to verify my insurance coverage. I thought the case was closed and I have no idea what company i had in 2006.

We recently received another letter asking about coverage that was separate and said we may be due additional funds.

Fortunately during that time frame I was with Geico for part of it and that is still in my email.

Where during part of that time frame I carried Geico I'm able to confirm that we had insurance.

I believe part of this is just a general settlement for everybody who was charged. And a second portion is for those who can verify or provide something that they had insurance.

I finally actually spoke to a attorney today and was told if they asked you for additional info re insurance it's because you probably not qualify if they dont ask you for additional insurance then you are good he also told me the letter makes it seem as though yes provide us with the insurnacebyou had and we will refund you but it's the exact opposite so just out of curiosity how long ago dis youget the fed ex letter and was it specifically addressed to your loan number?? Om me if you like

We've already received a check.

It was based on our loan and we received a check first now we are being asked if we had insurance through specific periods because we may be owed additional money.

I would find an attorney or call the actual CPI attorneys because the attorney you talk to you doesn't sound like he knows what he's talking about.

So, Wells Fargo repossessed my vehicle in September 2011. I received 2 notices regarding the lawsuits. I received a FedEx package requesting insurance information from 11/2008 to 9/2009. This was 10 -11 years ago. When the vehicle was repossessed, I was so humiliated and embarrassed. I have no idea who insured that vehicle, and I never purchased another vehicle after the repossession. Now what do I do?

Hello and thanks for the response. I rec'd the Fed Ex from Wells Fargo the 2nd week of October. Ive called since then and was told to just wait on the check. The timeframe in question is a 3 month span, however i had the vehicle for almost 4 years before it was repossed.

Hi, I also received a letter regarding the class action lawsuit. I had a Auto loan with Wells Fargo from 2007 to 2009. I received a call one day from one of their representatives offering me this insurance and said that it was full coverage. Well August 12, 2009, I was hit from behind by a man driving a Company truck. He hit me so hard it pushed me into the back of another car; the trunk of my car was pushed into the back seats. I go to file all the necessary paperwork and claims and find out that I didn't have insurance. Well, liability insurance for the state of Louisiana. The insurance that I was paying for monthly, added to my car note, was only for comprehension. I lost my job. The man that hit me was released from paying any damages, and to add insult to injury Wells Fargo sued me for the difference of what the insurance supposedly didn't pay and I had gap insurance. I had to eventually file bankruptcy. So my question is to anyone that can answer; do you know how much the checks are supposed to be and when will we be receiving them?

I recived a phone call yesterday 11/20/2019 9:22am from wells fargo saying that a check was mailed to the wrong address and they needed my new address, I said what is this about?? What check? thinking this was a SCAM,, But she told me that wells fargo had to pay 348 Million for a law suit I was invold in, i said Ok, heres my address and said how much is the check (thinking 10$ awww ok free cup of coffee) she comes back with I SEE HERE IT'S $$ 6242.40 $$ I **bleep** myself, told me I should have in 2 weeks, Perfit What a wind fall.

lleopold67 your situation has a lot more legalities to it than ours did. I don't know where you would stand where you accpeted that coverage.

See my ex and I did not accept that coverage. We carried insurance, yet our payments kept going up and up and up.

I received $117 in Jan 2019, I inquired about the amount, Wells Fargo office of the president investigated in June 2019 Wells Fargo sent me another check for $11k, I wrote Wells Fargo again stating $11K was not sufficient for defrauding me, and wrongfully repossessing my car. Oct 2019 Wells Fargo sent me a 3rd check for $31k. I received $42k in total for this Wrongful CPI situation.

Hi, I saw this post from this person as well on 2 different forums. This is starting to become more and more difficult to understand. I’ve never seen a case involving so much Settlement money handled in such a manor that leaves a door open for Wells Fargo to cheat its customers once again. That’s not a WIN and holes in the settlement if Wells Fargo is in charge of the settlement distributions.
