This account is old business, long since aged off reports (FCRA) and time-barred (SOL). Now, out of the blue it has been reported and is appearing on my EX report.

Right now it is probably helping my score, but it doesn't belong there and I want it off! I doubt this is AMEX's backhanded way of offering me the OASIS program. Who do I talk to AMEX or the CB? Or AMEX first and then the CB if AMEX doesn't make me happy?

I do have a wonderful consumer attorney on retainer down here who would love to introduce these folks to the FCRA/FDCPA, but I'd rather handle this one myself. I'd like to save him for the heavy lifting!

The same thing happened to me! I have not dealt with AMEX since 1997. It just showed up on my reports (pulled them tonight.) Here is what mine said on Experian....... sounds just like yours to a "t". Date of last activity Oct 2008. Uh, no! It also shows on TU and EQ. The DOLA shown on TU is June 1997, which would be just about right, maybe a few years even before then. I am willing to bet that we will be hearing from others on this soon. They are definately up to something alright.

I tried to post it as it was on the report, but it kept telling me I couldn't post it that way, because of to many characters. Anyway, above is the jest of it although it is hard to read.

I might add that it didn't help my score,Experian hit me for 8 points as it added the amount into my revolving balance. My utilization stays below 2% overall, most of the time around 1%.

Looks to me like AMEX is aching for a class action lawsuit for a massive violation of the FCRA. Probably some kind of computer error, but I might call tomorrow and see just how sorry they are for their transgression.

BTW: I am looking at a TC report and they do not present a DOLA. Also only showing on EX right now. I'll be checking again probably on Saturday. (I am checking to make sure BofA did not hard me when I opened a checking account. So far - so good on that one.) If they are reaging they are going to be sued for sure. This could be a very costly mistake on their part. Isn't that $5,000 per occurance?

Also, it would help my score - the amount is tiny and would not take me over 9% UTIL. It would be one more account reporting a balance, but also change my age of accounts severely as this account was opened in 1978!! (And it really was!) I think if you add this all up it comes out on the positive side.
Message Edited by jmbfl on 10-10-2008 01:12 AM

OK, OK, so I couldn't resist and I ran my myFICO EX report to see some details and...

1) My EX score went from 726 to 740 with that booboo reporting, and

2) It shows a DOLA of OCT 2008.

The real reason I ran this was to have hard copy proof that they reaged the debt, which I now have. Someone at AMEX is gonna be doing a lot of explaining to the bosses. This is the kinda thing that gets the FTC mighty upset!

jmbfl, by chance, did this show up on Experian only? I know the other poster in this thread noted that this was Experian. The reason that I ask... I had an old, aged off, credit card show up again, out of the blue, with a DOLA on 10/6/08. I actually posted it about it last week. I was certain that it wasn't mine, but I've since learned that the account number matches my old account. But, Comerica Bank insists that they didn't update.

I'm wondering if the problem is originating with Experian vs. Amex. Just a thought.
