@haulingthescoreup wrote:

What the law is going to be (assuming that we all survive to February, when it goes into effect) is that the due date will have to remain the same every month.

This is from a USAA article discussing its response to the new credit card law. Unusual among banks, they don't seem to be bothered by the law a bit:

Today: The payment due date can change each month. Your payment can be due on the 15th one month and on the 10th the next month. In fact, some credit card issuers have different due dates based on whether or not you pay your balance in full that month.

In the future: The payment due date on each statement will have to be on the same day each month.

USAA: 7 Ways the New Credit Card Law Affects You

That's a nice piece on the other end of that link. I found the comment regarding differing due dates amusing.

When I got my original PenFed Visa the due date was set consistently on the 16th of the month. I got the second one and it billed out about three days after the account was opened - also on the 16th. I called and asked a CSR if the second one billed on the 16th because the first one had or if it was a coincidence. The answer was, "neither". The due dates are tied into the last digit of the card number. Both cards ended in "6" so both cards are billed on the 16th. It is consistent, but it is also strange.

I have a Citicard Platinum Select MasterCard about 9 months old, 0%APR intro rate, "parking" $2k there while I pay it down on their dime.

I check the payment due date on the Citi website early every billing cycle as I prepare a spreadsheet, which I refer to all month as I schedule my bill pays. About every other month or so, the date they were showing at the beginning of the billing cycle has changed by the time I go online again to make the payment. On July 13, it said my due date was Aug 6, today I go to make the payment and it says Aug 4!! This is not the first month this has happened. I'm just glad I leave myself a few days of wiggle room.

I call to complain and ask for an explaination, of course they have none, the attitude was that I was "mistaken" (crazy). All they could say was they would monitor the acct to see if it happens again. I told them I had heard of this practice and believed it was done to trap people into late pays. Silence on the other end.

Has anyone else experienced this? Is there anything a customer can do?

to be safe use the auto debit function for the minimum pymnt by the due date, then make your other pymnt as you normally would. I do this will all my cc's that offer that option, this way they can never say I was late.

This is that nagging pain I've been having in the back of my head. I auto pay $60 in the middle of my statement, then PIF or max if I can't PIF by the due date. I really don't watch my bills at all, just balances. I just knew they would do that and somehow end up pricking me with a late charge. This sucks

Gotta make two payments every 1st and 15th of the month for an amount at least the minumum due.

If they offer, register for paperless billing. In this way you would get an email notifcation when the statement drops. Also register for paying them directly, rather than say Bill Pay. Most CCCs that offer direct pay would credit the payment the same day you make it as long as you pay by a certain time.

DW also has a Platinum Select and I also enter everything into a spreadsheet tracking of all things, due dates. Yes, they fluctuate depending on the billing cycle, but I've noticed a couple of times where they have posted one due date and within a week or two completely change the due date by a couple days at the least. I check every CC at least once a week and caught Citi doing that.

As of my July 3rd statement the only options were Quicken download or some delimiter nonsense. The older statements I can still view as PDF but not the newest one.

One of the violations Providian committed and was severely sanctioned for was the systematic past posting of payments. I don't see much difference between that practice and arbitrarily moving the due date back once the statement has been issued. If I could document such a change I would give them one shot at explaining it and then I would file a complaint with the OCC. What a reprehensible practice.

As far as Citi's explaination, they claim it's because each billing cycle is a different length of time, some months - 29 days, some months - 32 days, etc. Ok, fine, but I'm sure they do not make that decision each month, as is happens. The calendar is pretty much set, last time I checked. If they wanted to, they could schedule due dates to the end of time and there would be no reason to change them.

From now on, I will make it my job to document each and every month the due date at the beginning of the billing cycle and again when I make my payment. They're already caught, now I just have to prove it.

FYI, I heard of this practice in the mainstream media as the credit crisis exploded last fall. Problem is, I seem to recall it was legal. Anyone know the law on this?

How could it be legal? It is just as "legal" as Providian laying 1000's of checks aside and processing them a week later. They considered that to be "legal" and it ended up costing them hundreds of millions of dollars. Too bad Joe Average never saw more that crumbs.
