How long does it usually take for BBB and FTC to invesitgate/respond?

Submitted my dispute maybe 2 or 3 weeks ago and i have heard nothing from them, nor the CA!

I submitted a dispute with the BBB and it took the CA about 3 weeks to respond. I was sent an initial email by the BBB with my dispute number and was able to log on to see how long the CA had to respond. Once the CA responded, I was given a certain amount of time to accept or decline whatever offer the CA provided.

I got a call from the company within 48 hours. It was a public relations person incharge of handling complaints. She worked hard to resolve my dispute.

The BBB has no legal requirement or statutory periods to do jack poop.

But the CRAs are a different matter.

The legal dispute procedure is with the CRA, and no one else. The CRA has required investigation procedures and deadlines under the FCRA, as follows:

FCRA § 611. Procedure in case of disputed accuracy
[15 U.S.C. § 1681i]

(a) Reinvestigations of disputed information.

(1) Reinvestigation required.

(A) In general. If the completeness or accuracy of any item of information

contained in a consumer's file at a consumer reporting agency is disputed

by the consumer and the consumer notifies the agency directly of such

dispute, the agency shall reinvestigate free of charge and record the current

status of the disputed information, or delete the item from the file in

accordance with paragraph (5), before the end of the 30-day period

beginning on the date on which the agency receives the notice of the

dispute from the consumer.

(B) Extension of period to reinvestigate. Except as provided in subparagraph

(C), the 30-day period described in subparagraph (A) may be extended for

not more than 15 additional days if the consumer reporting agency

receives information from the consumer during that 30-day period that is

relevant to the reinvestigation.

not apply to any reinvestigation in which, during the 30-day period

described in subparagraph (A), the information that is the subject of the

reinvestigation is found to be inaccurate or incomplete or the consumer

reporting agency determines that the information cannot be verified.

(2) Prompt notice of dispute to furnisher of information.

(A) In general. Before the expiration of the 5-business-day period

beginning on the date on which a consumer reporting agency receives

notice of a dispute from any consumer in accordance with paragraph

(1), the agency shall provide notification of the dispute to any person

who provided any item of information in dispute, at the address and

in the manner established with the person. The notice shall include all

relevant information regarding the dispute that the agency has received

from the consumer.

(B) Provision of other information from consumer. The consumer

reporting agency shall promptly provide to the person who provided

the information in dispute all relevant information regarding the

dispute that is received by the agency from the consumer after the

period referred to in subparagraph (A) and before the end of the

period referred to in paragraph (1)(A).

The BBB gives the company 30 days to respond.

If you send the BBB a email stating that you filed a complaint against company XXXXX. You would like to know the status of the complaint. They will usually reply with a link that will allow you to sign in and check the status of the complaint. Anyhow, this is what happened when I inquired about the complaint.

The BBB is good about updating at the 30 day mark. They will send you a response, even if the company doesn't respond.

Is this company BBB accredited? If so, they lose their accreditation if they fail to respond.

Sidewnder, I am not arguing with you, for I dont know much about BBB. But fed law, as stated in the FCRA, does not legally require response to a third party, such as a BBB.

The law specifically says that the complaint must come "directtly from the consumer" to trigger the procedures and periods of the FCRA.

They could laugh at the BBB complaint, if they chose to do so. They have no legal standing.

You are correct.

They are not required to respond or take any action in regard to one's credit report when a complaint is made with the BBB.

I have disputed this Collection i believe 2 or 3 times and they keep verifying the debt, they have not shown me anything with the amount of charges, signature where i agreed to pay, etc.

All they sent me (which they consider validation) is write up about my visit to the doctors office and thats it!

They are trying to get off the hook, but im not going to let them!

Is anyone familiar with American Collection Enterprise, Inc.?
