Yep. Just make sure you did not just plug your info in and instead modified it to your situation. For instance, you cant ask them to stop collecting cause they are not since you have paid.

I PIF to a CA and they refuse to delete it from my CR. I was not even sure if it was mine - can I DV the account, perhaps they won't care about validating and just stop reporting it all together?

So you have already PIF'd? From my experience you may still DV the CA. I have had several CA's to delete after sending the DV. Now if this is correct procedure i really couldnt tell you only from my experience!

I know you can GW - but I wonder if a DV is a better way to go considering I probably should have had it validated in the first place before paying. I don't even care about getting my money back, although that would be nice if possible. I just payed it to fix my credit without understanding the consequences and going through the proper steps first.

already did - they will not - that's why I figure a DV might work because aren't they legally bound to remove it if the don't properly validate?

My other option is GW, but like I said I did already call which I have been told - never call a CA - and I will not anymore.

Im afraid it could be a done deal. The CAs dont have to respond to your DV and they I am positive will not, unless you reside in Texas. Your only options are GW letters and persistence. I think calling the CA now is not a problem.

So is that the consensus? If you PIF a CA is not obligated to DV? Has anyone tried this or know for a fact?

Will it not help my GWs if I DV - as in make them not like me. Is there a negative side to DVing after I have PIF? or is it just a waste of time?

I don't see how it could hurt. They can take no action against you. I don't think it would hurt your chances of a GW later if it does not work.

I wouldn't say its the consensus. Its just the general opinion so far.

The CA is not obligated to respond to DV not because its PIF but simply because they are not obligated to legally. They only have to respond to your DV if you have DVed them witihin 30 days of having received their dunning letter. A lot of things could be argued here but essentially thats the law.

What you need is leverage and you've lost a big chunk of that by PIF. Your only options are GW letters. Id skip DVing.

If you have never acknowledged the debt at any time and you have identified some CA violations which you think could help in fighting the CA, then you could DV.

ok - so I am going to DV and see what happens - I will keep you posted.

This DV letter I am sending is actually being sent within 30 days of their letter to me. So I think they have to respond even though I PIF (doh! still kicking myself for that - literally found out it was the wrong thing to do hours after I PIF).

I also wonder if they will take the time or care to respond considering it is PIF. If that is the case can't I send all the info to the CRAs with the certified mail info and DV letter explaining they did not properly show me validation and therefor can you (CRAs) remove this from my CR?

Is this perhaps a loophole I found for a work around PFD??

CRAs dont care if the CAs did not validate to you. As long as the CAs verified to the CRAs, they will continue to report. They will simply consider your mail as another dispute.

Keep your DV letter very short and simple and ask only for validation under FDCPA which includes copy of debt, name of OC and Balance.

yeah - doh! I did send it with all that info. This was like the last day I could send it and I rushed it a bit.

Well, it does also say you can't report it to the CRAs as well - so...
