New collection agency attempting collection on paid debt

Any help would be great. Approximately two months ago, son paid an agreed upon amount on a collection account to Alliance One. We have now received a demand from a different CA for the same account. Are there any sample letters on the forum that we could use to send to this new CA?

Hi and welcome to the forums.

Are they asking for the same amount of money or would it happen to be the difference between the settlement and what was originally owed?

If it is the difference, it is legal if there was no written agreement.

No, they are asking for the full amount of the debt - $665 when it was settled for $465. Appears they don't know it was settled w/other company? Or if they are just looking for us to be stupid enough to pay it again...

First you need to find out if the OC sold or owned the debt. Ask them which CA is supposed to be reporting.

I am thinking the CA you paid was either not supposed to be collecting on the debt or they sold the remaining balance to another CA to collect on.

well, we received the initial collection notice from CA #1 - son called them - negotiated settlement verbally - (yes, I know, should be in writing, but he's young) - they took payment info over the phone - and the payment cleared the bank end of Feb. Now, Apr 12th - receive new notice, new CA, same debt. Should we dispute this and demand validity. Son is trying to rent an apt and this showing up on report is not helping...

Yes, send the second CA a DV letter. They have no time limit to answer but cannot continue collection activity until they do. Reporting to the CRA, if it is not already reporting, is considered collection activity.

See what they have to say or see if they delete.

Is the OC reporting?

Yes, the OC was reporting it as an unpaid collection and we've been checking on it to see when it updated to being paid.

I'll have to have him run the report again to check.

Was the OC reporting a balance? If they were/are chances are they still own the account. You can contact them to make sure they own it.

If they do own it tell them the account has been paid and find out what CA they are showing it assigned to.

Ok, I pulled an equifax credit report just to see what it says - this particular account is not listed under collections - it is listed under closed accounts with the original credit card company showing it as a charged off account - there is no indication that it ever went to collection. The only collection showing is an old phone bill that has been paid - it's not showing as being paid either - but I've disputed it w/the CRA.
