So, I have a paid (2007) charge-off from HSBC that shows a DOFD of 2006. This is impossible, the account was sold in 2006, and I have documentation. I posted previously here:http://ficoforums.myfico.com/t5/forums/replypage/board-id/generalcredit/message-id/142867

I have a 2 yr old Experian report that shows a DOFD of OCT 2003-when sale of the account was concluded- but the actual DOFD date is 2002. The Experian report does not go back to 2002 on that particular trade-line in regard to payment history. I have disputed numerous times with CRA's, particularly Equifax, sending documentation, and requesting MOV. After typical stall tactics and 6 times trying to resolve this through equally stupid CRA's, I called HSBC. They said they are reporting a DOFD of 10/2006, but I need to contact the dept. that researches payment history if I dispute it. Instead, I sent a letter and documentation CRRM that shows the correct DOFD and evidence, demanding disclosure under FCRA statute A 609(a)(1) that requires disclosure. Predictably, I get a letter today that says they no longer own the account, and contact Collect America. I had already told HSBC over the phone and in my letter that my issue is with DOFD, not with collection agencies, explaining in detail that they need to provide documentation showing correct DOFD, otherwise I will sue. Do I now send an ITS letter? Do I call Collect America and demand removal? Can they even do that? Do I call and demand to speak to a person in authority?

I do the same jroxy. Judging from responses however, they don't read it. If they did, they would address the complaints in the letter, and not just spit out banal statements that don't address our concerns at all.

When dealing with bureaucracies and uninformed employees, there is no solution. Getting results from autocratic entities like CRA's is not a neat mathematical equation. Dealing with them requires being persistent, knowing your rights, demanding results, and luck. If your correspondence falls into the wrong hands, it just gets pushed into a pile that is categorized i.e. "account sold", or "previously disputed". CSR's are not informed, and are not exactly rocket scientists. They are hourly employees looking to just regurgitate the company line, and take the easy way out.

If you have them served with process, the complaint will definitely be read. If they don't answer, you win your case by default. Being ignored works in your favor in this case.
