      <description>&lt;P&gt;A call from a process server made me aware an old bank that I used to do business with is going to sue for debt of an old checking account from back in 2008.&amp;nbsp; &amp;nbsp; They gave me a phone number to this resolution center.&amp;nbsp;&amp;nbsp; I called the resoluton center and they asked me questions like if my debt was intended to fraud. They also mentioned I'm going to get charged a 1000 dollars for the suit being filed in court plus what I owe them. The place told me they can ask for more then what I owe them in the suit.&amp;nbsp; I did bring up it being past SOL and they told me the law has changed and I can still be sued.&amp;nbsp; I also mentioned I was disabled and get a check from the goverment.&amp;nbsp; There was a setllement offer, but I declined because I told them i couldn't pay..&amp;nbsp; Now, they're going to take it to court, so they clam. The alleged process server did give me a case number and a phone number.&amp;nbsp; This is the number they give me. 832 924 8115.&amp;nbsp;I didn't recive no letters or nothing, just a phone call from a process server who gave me the phone to the resolution center&amp;nbsp; who brought up the settlement offer. I feel so foolish&amp;nbsp; that I fell for this.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I feel so stupid for even saying anything. I should of just hung up.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;My credit is really screwed now and so scared.&lt;/P&gt;</description>

      <description>fdrfan54 adding to the other poster's comments ... how do you know this is not one of our many daily phone scams? Twice in the last two months I received notices from attorneys that I may have a claim on improperly handled Federal Bankruptcy Cases. They gave me addresses, telephone numbers and the date period of the BK happenings. Did not have a BK in their window of question. Where does this stuff come from? &lt;img id="smileysad" class="emoticon emoticon-smileysad" src="https://ficoforums.myfico.com/i/smilies/16x16_smiley-sad.gif" alt="Smiley Sad" title="Smiley Sad" /&gt;</description>

I called the place and they asked questions like if I intended to commit fraud with the debt or was it circumstantial.&amp;nbsp; They also wanted to&amp;nbsp;verify my birthday and last four of my SS number.&amp;nbsp; The place&amp;nbsp;claimed they were a debt moderation service whatever that is.&amp;nbsp; Another thing they wanted to settle, but I told they can take it to court because I didn't trust them.&amp;nbsp; Another thing it seemed like they couldn't pull up the&amp;nbsp;information on the computer. They had to put me on hold so they could get a piece of paper with the information .&amp;nbsp; They also came up with some nonsense about costing me a 1000 dollars for taking it to court plus other courts costs and fees if it went to court and that they sue me for more then what I&amp;nbsp;allegedly owe.&amp;nbsp; I brought SOL and they mentioned the SOL law has changed.&amp;nbsp;&amp;nbsp; I feel like this screams scam. I'm stupid for even speaking to them.&lt;/P&gt;&lt;HR /&gt;&lt;/BLOCKQUOTE&gt;&lt;P&gt;STOP SAYING IT WAS A PROCESS SERVER.&amp;nbsp; It wasn't.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;It was one of the jerkweeds who works for the company giving you the information for another jerkweed for the same company.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;Never mention SOL to debt buyers or anyone over the phone.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;We've told you on 2 different threads that this is a junk debt buyer scam but so far you haven't heard anyone.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If someone is going to sue you, they aren't going to tell you.&amp;nbsp; They will send a real process server to your home or work or at the grocery store.&amp;nbsp; No process server will EVER warn someone they're going to get served.&amp;nbsp; They get paid for serving someone, not for calling them and warning them.&lt;/P&gt;</description>

Even a junk debt buyer tries to scare people and they keep falling for this. Anything over the phone with no legal mail sent is a scam. Especially when they threaten police or lawsuits... educate yourselves people. Everything is verifiable if legal.&lt;/P&gt;</description>

      <description>&lt;P&gt;Twice in the last 14 months (one 14 months ago, and the other 6 months), I've had calls that a complaint has been filed against me and I need to talk to them; different numbers and different names.&amp;nbsp; Both times gave a fictional case number (doesn't match up with format that Californina uses).&amp;nbsp; Googling the phone number the first time said it was a scam trying to get personal information out of you.&amp;nbsp; The second time, nothing came up (till 2 days later when others started to complaing about it).&amp;nbsp; The second time, they even called my brothers ex-wife to tell them about it.&amp;nbsp; That sort of information can be found on the internet so it means nothing.&amp;nbsp; When I called the number back, it answers with an answer service that didn't identify who I was calling.&amp;nbsp; Huge red flag right there so I hung up.&amp;nbsp; Obviously, they are reusing the same phone number for multiple scams.&amp;nbsp; If it was a criminal complaint, it would be a government agency calling (though they'd be more likely to use mail).&amp;nbsp; If it was a legitimate civil claim they'd identify their law office when they called and left the message.&amp;nbsp; Certainly, the number they left would identify the office when called.&amp;nbsp; I figured it was either a scam trying to fish information for identity fraud out of me or a shady debt collector trying to collect on a debt that was out of the SOL and no longer on my credit report.&amp;nbsp; I had a few fraudulent accounts fall off my credit report last year and I figure it was for one of them.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;As others have mentioned, in almost all cases, you will be contacted by mail first and not a phone call if its legitimate. Because it's mail fraud if it isn't legitimate which is why they don't use the mail for these scams. If they are really going to serve you, they don't warn you ahead of time, because now you may become hard to find when they try to physically serve you.&amp;nbsp; Let's not even bother to talk about the ridiculous phone claims that the phone call itself will qualify as serving you.&lt;/P&gt;</description>

The person that quickly anwsered the call from the number I was given and called had to put me on hold to get a piece of paper with the infomation.&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;I'm going to consider this a learning experence.&amp;nbsp; I hope other people reads this and learns from my mistakes.&amp;nbsp; Just hang up.&lt;/P&gt;</description>

      <description>&lt;P&gt;Being doing&amp;nbsp; some&amp;nbsp;research on the phone number and all&amp;nbsp;&amp;nbsp;reverse&amp;nbsp;searches come up empty.&amp;nbsp; No name or nothing. The only thing I discovered it's a VOIP number.&lt;/P&gt;</description>

Generally, if you acknowledge the debt, the clock is reset. Different jurisdictions may have different rules as to what that means but it could be something as trivial as you verbally agreeing that you owe the debt over the phone even if you don't agree to pay it. If they wish to pursue you, they'd need to produce the recording and have the courts rule the debt as valid.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;If you are concerned about this, you should contact authorities and lawyers in your local area who are familiar with laws where you live. Agencies like the state attorney general, consumer protection office, or even the CFPB can be good resources to ask. Otherwise, you can pretend this never happened and hopefully nothing will come of it.&amp;nbsp;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;As for why they call you, because they are scammers. Why do burglars sneak into home in the dead of night and take things that don't belong to them? Because that's what they do.&amp;nbsp;&lt;/P&gt;</description>

Telling you about possible criminal acts is a big FDCA violation and also most state laws. If the firm were real they just earned enough in fines and jail time to pay your case 100 times over.&amp;nbsp;&amp;nbsp;&lt;/EM&gt;&lt;EM&gt;In many jurisidictions you have to tell the other party it past the sol. Also once they made contact they have 5 days(i think 5 days )&amp;nbsp; to mail&amp;nbsp; youI&amp;nbsp; a written notice. I and DW have gotten these calls. Fake&amp;nbsp; &amp;nbsp; scams.&amp;nbsp;&lt;/EM&gt;&lt;/P&gt;&lt;P&gt;&amp;nbsp;&lt;/P&gt;&lt;P&gt;&lt;EM&gt;&amp;nbsp;&amp;nbsp;&lt;/EM&gt;&lt;/P&gt;</description>
