I submitted a dispute with Transunion through Credit Karma as on October 23rd. It is past the 30 day mark with no results. What should my next step be? There was a holiday in there so should I allow more time?

UPDATE: it has now been 45 days and still no response from Transunion.

They will tell you over the phone if it is in process or not. They can also likely tell you the estimated completion date.

The dispute process timeline under the FCRA does not require that the consumer receive results of a dispute within 30 days of filing.

The process, from date of filing until date of receipt of decision, can routinely take up to approx 45-days.

In more detail, the FCRA sets a period of 30 days from date of filing for the CRA to conclude its investigation, unless the consumer sends additional communications regarding the dispute during the reinvestigation period, which will then extend the reinvestigation period to 45 days.

The CRA then has five business days after expiration of the reinvestigation period to make their decision and communicate their Notice of Results of Reinvestigation to the consumer. Thus, it can be up to 38 days from filing, assuming a 30-day reinvestigation period, before the CRA is required to communicate their decision. If the Notice is mailed, then an additonal 5'ish days is tacked on.

Thirty days from date of filing is too soon to assert lack of timely receipt of the Notice of Results of Reinvestigation.

I would give it at least a month and a half.

It was a collection account that has been paid in full to the original creditor, less than $100. I never received anything from CA. When I initially contacted them to find out what the collection was for (it was listed with an unfamiliar name on report.) They told me it was for DirecTV. After talking with DTV several times and calling the CA with them on the line they then said it wasn't for DTV but but for an internet provider I had a few years ago. The internet provider accepted payment, said it was submitted to collection in error and said it would be removed.

If the furnisher does not respond back to the CRA during the reinvestigation period, the CRA must then still conclude their reinvestigation.

Normally, the CRA only has the response from the furnisher as basis for their determination of whether they will verify the accuracy as reported or correct the reporting, but that depends upon the fact situation. Regardless, FCRA 611(a)(5) requires the CRA to still make a finding.

The CRA cannot simply wait, and delay their conclusion of the reinvestigation.

If they do not have sufficient evidence to verify the accuracy, they must either correct or delete the disputed information.

However, correction or deletion pertains only to the specific information identified in the dispute, and does not require deletion of other accurate information or of the entire account.

If the CRA does not comply with the requirments of FCRA 611(a) by completing their reinvestigation within the statutory period, or mailing the Notice of Results of Reinvestigation within the required 5 business days after conclusion of their reinvestigation, they are subject to either formal complaint directed to the CFPB and/or civil action by the consumer for the violation.
