Yes take the above advice and hire a lawyer if necessary. I am interested in knowing if LifeLock type services can help escalate things with the creditor and make situations like this easier. I hope so because I pay them $360 a year. If it saves me 360 hours of headaches with identity theft it would be worth it.

But rest assured OP it is always on the creditor to prove they did due diligence and produce technical information surrounding your online application and digital signature. Fraud is typically easy to prove however because the cookie/browser/OS patterns of the person who signed up for the product likely don't match yours.

Should make it easier to dispute. You should put your reports on ice

Do you know that the creditor made an inquiry, and thus was aware of your fraud alert, or did they grant credit without any inquiry, and thus any knowledge of the fraud alert?

Yes, I saw the inquiry and immediately contacted them ( January). They’re still sending me delinquency notices

I’m kind of confused. Are you saying a lender granted credit to someone who opened an account fraudulently using your identity. And, now the account has gone delinquent and you are getting notices?

If yes, two things. Have you filed a police report and do you have an idea who the person is?

I was under the impression when someone had a fraud alert, they were given some sort of passcode or pin that had to be used when opening a new account. Am I misunderstanding what you’re saying?

So I had an active fraud alert when a loan company activated a fraudulent account without contacting me at all. I discovered this when I noticed the inquiry on me credit report.

@Anonymous wrote:
So I had an active fraud alert when a loan company activated a fraudulent account without contacting me at all. I discovered this when I noticed the inquiry on me credit report.

Here are your steps in short order:

1. Write the creditor and bottom line them that you did not open the account, you had a FA on file at the time and that they have broken the law governing FAs and you are demanding removal of it from all the CRAs and C&D all communications or you will sue. If this fails

2. use the laws in the FCRA to have it excluded for good under ID theft and I would still look into possible recovery from the creditor for failing to follow the laws and I would also freeze all CRs at this point as they are free to lock and unlock now, they wont even be able to pull credit with a freeze.
