I have been disputing the same item, and even sent a copy of a letter from the IRS, because the IRS had taken my refund to pay for it, and it clearly states the amount that was sent to this particular creditor, with the date and address it was sent to, in black and white, and they still continue to say that the item was verified as correct. Are they stupid? I just requested proper MOV, stating that I wanted a contact name, address, phone #, and I also told them to NOT send me "we used an automated verification system, for MOV. The more I have to deal with these people, the more my blood pressure goes up. Do they make money off of keeping your credit bad or what? What the @#%$ is their deal?

I was listening to Clark Howard today on the radio and he advised people to start suing CA's so I am sure this may work for CRA. You can sue them in your own county and they will spend more money trying to answer the law suit and will most likely settle with you. What would you have lost, maybe 60.00 to file the lawsuit and time! Thats all. CA's depend on the fact that most people will NOT sue them. If you live on the East Coast and you have CA on the West Coast it will cost them money to answer the lawsuit and hopefully settle!

I currently have a similar problem with EX verifying bad information.

EX reports "BK/CO" as the current status on two of my old Am Expr accounts which were included in my CH7 BK that was discharged 15 months ago. Both EQ and TU carry the status of these accts only as "BK".

To clarify the situation, I called the Am Expr credit reporting office (800-874-2717). I was told they are reporting both accts to all three credit bureaus as only as "BK". So, I disputed at EX, relating what Am Expr told me and EX came back with the "BK/CO" as verified.

I guess my next step is to try and get AE to put what they told me over the phone in writing. They were grumpy when I called the first time, so I'm not too optomistic they will write a letter.

But then there's the even worse mess at TU <sigh>... After submitting my CH7 BK disch and creditor schedule, they misconstrued a "paid as agreed" $30K car loan with BOA (paid off 2.5 years before BK was filed) as

I disputed immediately, including copies of the CR pages showing TU's tradeline on it both before and after their mistake. They responded by deleting it entirely.

I then called TU and got a lot of excuses that they can't add a tradeline. Asked for a supervisor and finally got switched to TU's 'special handling department'. They are due to respond by 8/12. IF this problem gets resolved at that time, it will have been a ten week struggle.

If you read enough complaints about EX, it becomes very clear they consistently resist taking action on disputes, no matter what the circumstances. They are well aware that only a tiny number of consumers will ever bother to file a lawsuit regarding a legitimate dispute. So 99% of the time, consumers get the "previously verified" letters and other brick walls thrown up in reaction to their disputes. It is a very efficient method for EX to allocate their resources, and their policies are beneficial to creditors and collection agencies because the OCs and CAs are able to maintain pressure on consumers by affecting their credit reports. Remember, OCs and CAs are Experian's customers, and EX creates and sells a long list of products to assist collections.

IMHO, the least aggravating way to deal with an EX problem is to (1) dispute it the usual way, understanding that you only have a 1% chance of success, (2a) if the dispute is substantial and worth a lawsuit, retain a lawyer, send EX an Intent to Sue letter, and file suit if you don't get a response (in many cases, EX actually do respond once they believe you might file suit), or (2b) give up until the item falls off your CR, and accept that your EX score will be depressed until that happens (if the OC or CA don't change their reporting, you are banging your head against a wall if you continue to try to dispute with EX).

My DW has a bogus collection on her EX report. We successfully had two instances of the same bogus collection removed from EQ, but hit the usual dead-end with EX. Her FICOs are 771, 761, and 690. Guess which is EX. The collection is only for $44, and mortgage lenders and auto lenders disregard it, so we will just ignore it for another year or so, even though it's annoying to see it on the CR.

By the way, the staff at EX aren't idiots, they're Vogons ...
