I would call your ex-employers legal department. Explain that if your credit rating is damaged because of their actions you would seek to be compensated for a lifetime of higher interest payments -which could run into millions of dollars. Ask them to prevent this by setting up a meeting with the comptroller (or whoever can authorize payment), where you can explain why the expenses were legitimate. At the end of the meeting request an acknowledgment on company letterhead that these were legitimate business expenses and that they will pay them. Copy it and fax it to any collectors.

From the T&Cs of one of the Amex Business Cards

I have advised Additional Card applicant(s) that you may obtain, verify, exchange, and use information about them in the same manner as described above, that they may be responsible for payment of their own charges if I fail to pay them, and that their own credit records may be affected by nonpayment of the account. I understand that Additional Card(s) will not be issued to me if I have an unsatisfactory account with American Express or if the Additional Card applicant(s) have ever had an unsatisfactory account with American Express

Now I now that Amex will not even issue an AU card without a SSN. What did you sign when you accepted this card from your employer? Where there terms where you would be responsible for repayment if expenses were not approved?

Hi There,

I would definetly work back with the company you worked for and have them take care of this. Did you have a formal way of submitting claims through your employer? Did your manager reject the claims or never approved them? Does the manager still work there? You might need to take some legal action.

From my experience, i had my card not paid for about 6 months. I called AMEX and was working with my employer. I didn't want my name going into collection because my employer was late in making the payments. AMEX said they didn't report for 6 months because it's a corporate account.

No need for a legalism yet. Call your comany boss and ask him to remove you as a AU. Now call the AMEX and tell them that you were just an AU and did not rack up these charges. Usually, AMEX will take you off their AU status if you ask nice and do not threat them in any way.

But it is not unheard of that AMEX goes after everyone that ows them money.

Try in nicely, wouldn't hurt.

Amex does not have AU so to speak. Any cardholder for Amex is just that, a cardholder. He also signed an agreement to be liable for the charges.

OP:

As far as the collector is concerned. You say they are giving you 24 hrs to make good. First of all they CANNOT threaten you. Second of all, is tgis first contact wih these people? They MUST give you thirty days to acknowledge the debt. When you are dealing with scumbags its best to do so in writing. Send a CMRR stating that this debt is not yours and refer them to your former employer. At this point they will need to contact them and AMEX to find out if you a re truly liable for the debt.

While they are running around with thei fingers up their noses, this would be a good tme to see what your liability is by a: Contacting the company yourself and finding out why these expenses were never paid to Amex.b: getting a free legal consultation.

I have a corporate card and in the card holder agreement it states that the user may be liable for any charges that the company does not pay. This is to protect the company from non-business related expenses. I would call the head of the company's Finance-Expense department to see what can be done to resolve this matter. If these were all legitimate business expenses the company should pay them.

unfortunately Amex is the only credit card issuers out there who can hold authorized users responsible if the primary cardmember refuses or does not have the means to pay the account.

Amex does not have the right to list it on your personal credit report if you are not the president of the company; however if they decided to sue you and get a judgement in their favor, this will be on your credit report.

i think the only way you could probably clear this up and have a legal leg to stand on is if you were able to prove discharge/sepration from the company before the bulk of the charges were made and the account went into default. (of course the could be no card activity for you during this time).

Sorry I hate to do this. Read through this and if they contact you do anything listed here, make sure you hae notes and names. They are already in trouble with the FTC. I would also challenge permissable purposes for a hard pull on your credit file just lay low until they make first contact though.

Actually I think the 24 hours thing counts as a threat. Report em, they are already onthin ice. they will probably bounce it back to Amex aster than you can shake a stick at them.

That inwuiry is coded as if you applied for a new installment loan....oooh against FTC regs..... keep a copy of that andinclude it in your email that you did not apply for new credit but they coded it as such. Burn Em

Message Edited by Brammy on 09-13-2007 11:13 PM
