When PFD doesn't work....

You look at your credit report and realize that you have a recent collection on there. After you confirm with the OC that the debt has been sold, you DV the CA and dispute with the CRA. The CA validates, and the CRA verifies.

You then try sending a PFD, but it is ignored. You send another, they respond by saying they will not remove it. What do you do next?

Wait 6+ years for it to fall off? Wait 3 years for SOL, then re-try? Pretend it's not there, and hope to not get sued? Just pay it off for closure?

What company?

If it were me, I would just resend in a few months and try to work my way up there. Eventually they should get the hint that you mean business.

Time it so they get the PFD in the last week of the month.

Yep- rules seem to change at the end of the month and someone wants a bonus.

My GF is dealing with CACH LLC, but the question was more in general terms. In her case, she'll just send a PFD every 2 months until something happens; either an acceptance, or (hopefully not) a lawsuit.

In general, I was curious what other people have been doing. I assume a lot of people that send PFD letters either don't hear back, or they get a response that the CA won't accept it.

When I advise people about disputes & all other things that can be done....I always tell them to check their SOL before beginning anything. That way there are no sudden lawsuits.

Even a dispute can trigger it. If you dispute, send a DV or anything within SOL they can get ya!

I learned one thing from CACH LLC. They are very quick to accept PDF only if you attach with the request a FDCPA violation committed by their representative.

Document violations, then send it to their compliance department CMRRR. Demand that a reply be sent to your gf within 7 days. It worked for me.

By the way, I dont think CACH, LLC collect debt by themselves. I think they only buy accounts and hire law firm or independent collector for them. At least, that was my case.

I got out of collection, got myself deletion, and a decent amount of $ as a settlement. They only asked me one thing in return, not to SUE them by signing a release of claims.
