Dispute these in writing- the dispute will start

It is your legal right to dispute unless the dispute is found to be frivolous.

Back in like 1996 I had a cell phone with ATT that I lost due to unemployment. It is a valid collection. However I completely forgot about it, and then when Cingular took over ATT, they listed it as well, while still leaving the ATT collection on the report.

Now that ATT has taken back over again, I now have 3 collections for the same account on my report!!! How do I kill the duplicates, so that I can just work with the one valid collection?

Can you guess when the DOFD (date of first default; when the account went 180 days late) was? Also which state do you live? These questions will determine if the collections are too old to report and your SOL (statue of limitations).

I live in Texas where the SOL is 4 years, this debt is definitely old. But as far as I know they can still try to collect right?

At the same time, I noticed that multiple times over the course of time with many different 3rd party collectors touching these accounts the DOLA's have been changed quite frequently, and it also seems the DOFD might have been changed at some point in there too maybe?

The more I think about this account the more upset I get.

look at your CR EX and TU do you see drop off date...if so what does it say??

They can always try & collect no matter how old it is....They CAN NOT report after 7 years....in fact there is a 90 day limit when they MUST report.. In other words the OC must report CO no later then 90 days after CO......this keeps them from extending the 7 yr drop off.

They can NOT file suit after 4 years.

Message Edited by HappyDays on 09-05-2007 11:35 PM

I can't dispute the one with Calvary anymore because they won't remove it. I've disputed it so often that they listed on the account "consumer disputes this account information."

So what can I do now?

Also, the first delinquent date shows 11/2001 for one, and 05/2002 for another. Are those the DOFD's? Or are those delinquencies with the CA's so my DOFD is probably earlier?
