It almost sounds to me like they intend to delete the TL, not (or not just) the INQ... and that would be a good thing. I'll assume that the TL was not originally a PFD arrangement.

Since they have not acknowledged the INQ, you can go ahead and sue... or write them again and ask for a $500 settlement in lieu of going to court IMHO.

However, if getting both the INQ and TL removed would be enough for you to cut your losses so to speak, sounds like that letter would support the TL being removed if you wanted to FAX it in as a dispute, and dispute the hard INQ directly with the CRA as non PP. I personally would call it a day once that was done, but you could still do a second non authorized INQ letter after that.

Does collection agency Asset Acceptance have the PP to pull a hard copy of my CR?

I settled with them in April however, I noticed on my CR that there is a HARD PULL from them on 05/08/06. I sent them a letter (CMRR) asking to remove the inquiry "within one day" of receiving letter or else $1000.

They responded as follows:

according to our records, we are currently reporting this information as a "paid collection" on your credit report. Please be advised that the Credit reporting Agencies may not update the data we furnished them on a daily basis, therefore, please use this letter for verification until your records have been updated.

Basically, they ignored my request and verified that I have a paid collection. Nothing about pulling a hard report and removal. Could this be if they acknowledged a violation of a PP hard pull, they can be liable for the $1000 violation?

How shall i proceed? With another letter? Call? Anyone wil a similar situation?

thanks smartcke,

hmmm that would be nice if they would delete the TLand INQ. it would be worth it..Although, i did not think thats what it sounds like. now that you mention it that could be the case.

yes they have not acknowledged the INQ, any threads or sticky/sample letters for intent to sue?

what is the IMHO?

I had already tried to dispute with EX directly (before i recieved the letter) for non PP but was told "you have to dispute directly with Creditor". So what you are saying is that I explain to the CRA that I disputed with Asset and they did not acknowledge the hard pull?
