      <description>I got a letter from AFNI and it says exactly as follows:&lt;BR /&gt;&lt;BLOCKQUOTE&gt;Dear Valued Customer,&lt;BR /&gt;This is in response to your recent inquiry regarding Afni account number XXXXXXXXX-02. We have&lt;BR /&gt;verified with the creditor the following information:&lt;BR /&gt;Creditor: CINGULAR&lt;BR /&gt;Original Creditor: CINGULAR&lt;BR /&gt;1801 VALLEY VIEW LANE&lt;BR /&gt;Creditor Account #&lt;BR /&gt;FARMERS BRANCH, TX 75234&lt;BR /&gt;Acct: XXXXXXXXX&lt;BR /&gt;Balance 551.60&lt;BR /&gt;This letter serves as verification of the debt. Upon mailing of this letter, in accordance with 15 USC 1692g, Afni will resume collection activities.&lt;BR /&gt;If you have any questions, please contact our office toll free at (888)804-2409 Monday through Friday&lt;BR /&gt;8am-5pm CST&lt;BR /&gt;This is an attempt to collect a debt.       <description>The way I read § 809 - this does constitute Validation-&lt;BR /&gt;They should also indicate if they own the debt or if they are collecting on behalf of the OC.&lt;BR /&gt;&lt;BR /&gt;&lt;BR /&gt;§ 809. Validation of debts [15 USC 1692g]&lt;BR /&gt;&lt;BR /&gt;(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing --&lt;BR /&gt;&lt;BR /&gt;(1) the amount of the debt;&lt;BR /&gt;&lt;BR /&gt;(2) the name of the creditor to whom the debt is owed;&lt;BR /&gt;&lt;BR /&gt;(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;&lt;BR /&gt;&lt;BR /&gt;(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and&lt;BR /&gt;&lt;BR /&gt;(5) a statement that, upon the consumer's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor.&lt;BR /&gt;&lt;BR /&gt;(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.&lt;BR /&gt;&lt;BR /&gt;(c) The failure of a consumer to dispute the validity of a debt under this section may not be construed by any court as an admission of liability by the consumer.</description>

      <description>Except that I disputed the validity of the debt and requested proof of the debt. That proof has to include a signed contract or something similar.&lt;BR /&gt;&lt;BR /&gt;I'm pretty sure that the FCRA requires accurate information. If they want to claim I owe, they better prove that I owe.&lt;BR /&gt;&lt;BR /&gt;There's no way that this is legal validation.</description>

      <description>&lt;DIV&gt;Technicaly, you dispute with a CRA (not a debt validation).&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;You need to DV AFNI and send an MOV to the CRA, when it comes back that it was electronic verification then you ask for a an investigation wanting to know who they speak with, what company,etc...&lt;/DIV&gt;</description>

      <description>&lt;DIV&gt;He could do all that but what's the point, if he/she doesn't want to turn the person in.&amp;nbsp; The debt in it's&amp;nbsp;self is&amp;nbsp;valid and he know's who did this to him.&amp;nbsp; so the money is technically owed the op just has to decide if he/she want's to take the hit for what someone else has done and live with the damages.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;I personally would talk to that person and have them help the person out in this situation so the person doens't have to live with the consequences.&amp;nbsp;&amp;nbsp; At the very very least have the person pay for it.&lt;/DIV&gt;</description>

The CA can commit a violation here, that you can sue over, even if you never DV.&lt;/P&gt;&lt;P&gt;§ 809(b) states the customers right to DV. Now if the DV merely needed to contain that which was required to be provided in § 809(a), then what the heck would be the point of DVing under law? To receive a duplicate copy of the § 809(a) statement? I think not.&lt;/P&gt;&lt;P&gt;§ 809(b) compliance demands something more. Exactly how much more will be up to your District or Circuit court decisions.&lt;/P&gt;</description>

      <description>I think I'm going to legally pursue this further. My friend made his bed, now he has to lie in it. I will fully testify that he is a changed person, but I'm not going to be stuck fixing his mistakes at my own expense when I'm trying to fix my credit, which lately seems all to important.&lt;BR /&gt;&lt;BR /&gt;I further think that if they do not have *MY* signature on the debt of which they need to prove then this is not verification that *I* owe this debt, and as such should be removed from my profile.       <description>&lt;DIV&gt;JSchaffer,&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;I had the same thing happen to me.&amp;nbsp; A close family member that lived in another state&amp;nbsp;got cable in my name.&amp;nbsp; I noticed it on my CR about 2 years after the fact.&amp;nbsp; I first contacted the CRAs and they put a 30 day FA on my CRs and I personally called the cable company and their fraud department investigated the matter and within a week or so I received a letter that I didn't owe the money and it was removed from my CR.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;My point is that this family member never even knew I found out they did this. There were no reprocussions for her actions.&amp;nbsp; (She had long moved before I found this on my CR.)&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;I hope this helps.&lt;/DIV&gt;</description>
