some one help me quick!!!

I hate afni collections....I have a account them and they sent me a settlement offer. The collection is from 02...they said that they never sent me a settlement for $800.00 and the settle ment is 1200. I went online and the settle ment is said to be 850. If paid in full it would be 1600. I have scores in the upper 600's and want to get this out of the way. Shoul I pay in full, cause they won't PFD. Or pay the Settlement?

Hi Laryn41: Are you for certain that the chargeoff is 2002? Do you have a papertrail from the original creditor showing the date of last activity or the date of first delinquency? I noticed you posted a few months ago regarding AFNI and at that time you said it was 2004. Do you only have one account with AFNI?

AFNI has a bad habit of reaging info so before you commit to paying anything you should have this ammo in hand.

they have nothing on me. document wise. they have my billing info from the first time of service.

Well, I noticed that you were able to get a CLI recently and you said your scores are in the 600's. I really don't think this collection is hurting you since it is so old. Be careful paying them now, they are very nasty and it may actually hurt your score as the newly paid collection will show up on your report and will be reported for 7 years after the date you pay it.

Have you been able to get any new credit? Surely you have gotten some cards recently?! If so, has anyone declined due to collection?

They don't delete when they say they will and right now I am in the process of filing a lawsuit against them for my brother.

They have a 2003 paid Alltel account that they refuse to delete even with proof.

Well what you don't do is to discuss things with AFNI till you know what you do need to do.

I'm not familiar with all the details of the original situation but what type of debt collecting SOL are you looking at with this? Does the OC still own, or have they sold the debt to AFNI?

Did you DV AFNI?

The Oc sold it to afni. They told me that SOL is 2011 but that after that i will still owe the debt but it will fall of my reports. also, if I PIf It can only help my credit right? i have gotten some recent credit...but no very prime, Chase, citi, etc.Alot pf my denials are new debt and excessive inqs. Thye want me to settle for 748.00. The original debt in like 1800. already paid 200 mths ago.

The debt would still be valid but they could not report it to your CB after that time. That being said, without paying it, it will probably be sold over and over to zombie debt collectors until they finally figure out that you are not paying it. If you take that route, you should prepare for calls out of the blue even after the date. That being said you could then direct them to the nearest river for a quick jump.

REMEMBER after the 7 year period it should never again show up on your bureaus. Keep records, and make sure that THEY know that YOU know on every contact.

You need to check your own state's debt collecting SOL for whatever particular type of debt this is. You go by the DOFD or the DOLA. If you just pay the collection... it is still a major derog on your CBRs until it ages off (7 years from DOFD/LA give or take 6 months).

Now, if you are saying that you paid $200 on this debt months ago... that very well may have re-aged this account and so now you are looking at a DOLA/DOFD from 2007.

Did you DV AFNI? If not, do so. If validated and you want that settlement offer, you need to PFD if you want this off of your reports now instead of it being there for what sounds like 7 more years.

so I I should either PIF or not pay at all...I am really looking to get my credit great...perfect. i would like a prime card. that means npo more inq.s and sit good on my current cards. I did get approved for a 300,000 morgage though.

If you PIF, remember PFD. Let them know that you realize that paying the debt will not remove it from your reports. Won't even help your score much. But find out about the SOL in your state first.

they said i can't OFD, I would have to contact each report agency and they are the only ones that can do that...the sol is 7 years i have like 3 to go.

Yes, do not continue payments. Not only will that stop re-aging the collection, it will get AFNI more interested in a a future PFD.

Please, DV just so you can say you did.

They can PFD. They were hoping that you would take their first 'no' as an absolute.

You do not have 3 years to go... please research SOL, CRTP, and re-aging.

Are you sure thats your SOL and not just the reporting limit? Seems awful long for an SOL.

In KY SOL for collection is very ambiguous, and is either 5 or 15 so most of the creditors go w/ 7 yrs on average.

I know, I can't make heads or tails of it either, I wish I could go for 5 but that is mostly for oral contract, and yet the 15 is too long too.

I have no idea where to begin. Isn't the sol 7 years from the date it is starting to reporting? Then it falls off your reports? also they have no paper work to send me. It's all computerized and they can not send me any paper work. how else can I validate it? I sent $200.00 months ago would that me I took the debt as my own?

Ok the reporting date is the 7 year period. The statute of limitations, or the amoutn of time they have to pursue legal action varies from state to state.

What happens if the SOL is in affect but it is still on my report? I don't think that pretains to me because I made a payment. Therefore it starts over again correct?
