    <description>&lt;DIV&gt;&lt;/DIV&gt;&lt;DIV&gt;I know that after having read everyone's trials and tribulations with debt collectors, I should be more prepared to distance myself emotionally from this process (that I am helping someone else with)&amp;nbsp;... but it's DIFFICULT when they are so under-handed in the way they approach the collection process.&amp;nbsp; My greatest sympathies to everyone who has ever had to deal with these situations.&amp;nbsp; This one is the result of an honest mistake and it's becoming a nightmare.&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;Am I missing something here ... or isn't drafting someone's checking account (without notice or authorization ... but claiming authorization) to collect the debt in question illegal?&amp;nbsp; I know it is a "he said ... she said" thing ... but WOW!!!&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;The 30 days allowable for dispute after receiving the written notice of the debt has not even expired yet, but they claim that they do not have to wait 30 days before they automatically draft the account.&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;I know that if you dispute the&amp;nbsp;charges&amp;nbsp;that slows things down.&amp;nbsp; But ... how are they justified in automatically drafting the account BEFORE they have given you the proper time to dispute OR to pay?&amp;nbsp;&lt;/DIV&gt;&lt;DIV&gt;&amp;nbsp;&lt;/DIV&gt;</description>

      <description>denbar, I'm not an attorney, but I'd sure say that's illegal!&lt;BR /&gt;&lt;BR /&gt;Worth talking to a shark attorney, and suing their pants off, IMO.</description>
